"... I did not threaten him, although my language left a lot to be desired... "
You need to be a bit careful here, because many people find 'language', in itself, threatening (I do myself, it might be a generational thing!). Did you tell the guy who made the complaint against you to f*** off as well? You could have a problem there, talk with your legal advisor on Wednesday. You may need to show that this is the normal reaction of someone unjustly slandered and accused of drug taking. De-emphasise the amount you'd had to drink, it's not a point in your favour.0 -
Well im female and if someone falsley acccused me of drug taking and was rather opioninated, after a few drinks i would definatley be thinking along the lines of the OP. Most people after a few bevvies can change in their personalilty, even the most calmest of people, my present job in retail i often see this at the end of my shift.
I consider myself to be rational, but after a few drinks im the first to amit i change. And if you accused me of being a drug addict, i would definatly be telling you a peace of my mind.
I hope the OP manages to win this one, common sense should prevail that hes no addict.

The problem is, as this was a works 'do', it counts as being at work. What would happen if you told a manager to f*** off at work? Well having a few beers is no excuse, the only possible line to take is to assert that this was a reaction to a false allegation of drug-taking itself made in an aggressive manner. It would help if the OP could provide witnesses to show that he used no 'language' up until the point the drugs allegation was made.0

Anihilator wrote: »This paragraph about sums up your chances I am afraid. Whether you like it or not that is abusive and threatening behaviour in the eyes of most people.
If the next paragraph comes into it well you may as well just resign now.[/QUOTE]
Will you knock it off, in case you hadn't remembered the OP was unjustly and falsely accused of taking drugs, humiliated by the manager in front of his colleagues and now suspended whilst he has to prove his innocence....why should the OP resign?
If a manager did that to you, would you just say 'ho hum, erm ...ok, I'll stand here and have you threaten my security, livelihood and prospective work and humiliate me and not offer a response in case you interpret anything I do as threatening'.......I think not!
Given the manager was saying things like 'I'll stand by you, if you confess now'...!!!!!!....this guy is totally unprofessional, he is not a Police Officer, there is no evidence and the OP never stood a chance of protesting or proving his innocence when he has a manager on a mission to get rid of him.DFW Nerd 267. Things DO get out of hand at Xmas parties where drink flows freely, and people say the wrong thing, Make a note of everything for Wednesday, in a summary form and go over them with your advisor before the meeting. Try not to be put off by Anhilator, he is probably back under a bridge looking for three billy goats gruff.0

Good thing about Anihator is he's a troll, and you can afford to view anything he says as always incorrect.
But it is now serious, you need good legal advice, you need to record what has been said and done, you need a witness in the meeting with you, and need to make notes during the meeting.
Ensure they note you will voluntarily submit to an independent drug test.
If you do, you need the usual two samples route.
Contact Acas as well, sometimes then can provide advice as to what route to go down.
He's also not your line manager, so he hasn't probably hasn't followed the procedures for dealing with this in confronting you in a toilet, he probably should have gone through HR/your manager.
Above all though, be calm.0 -
Now who's spinning?
OP, can you please just put Anhiliator on block. He/She is a well known troll who obviously lives a very sad life to manage that many posts in such a short space of time...
You need to hold your head high here, and fight this every step of the way. This manager is the one that should be suspended due to their outrageous behaviour, so you need to put this in writing, and submit a formal complaint against him.
Don't forget to mention on Wednesday that you offered a drugs test and it was declined.
You will NOT lose your job over this, and if they do try and sack you, you should fight it every step of the way.
Let us know how you get on on wednesday.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
OP, I think you need to be congratulated for not losing your cool and punching this bullying Manager. Have to say and admit that if I found myself in a similar circumstance I'm not so sure I could of kept my composure as well as you.
So you got fed up of trying to defend yourself and raised your voice and swore at a couple of people, SO WHAT ? Totally understandable under the circumstances. Bottom line is if this guy hadn't accused you and then spread malicious rumours then you wouldn't of needed to swear etc
This guy accuses you of being a druggie simply on the grounds that he heard you sniffing in a cubicle !! !!!!!!....he can't even say he actually saw you doing it nor provide any evidence whatsoever that you did that night or any other night take drugs. And then not happy with that he then spreads these rumours to other members of the company BASED on a sound.
I hope you have contacted an employment solicitor to start proceedings against him and even your company simply for acting on the word of another employee ?
In hindsight you should of spent the weekend compiling a statement against this Manager and handed it into HR first thing Monday morning.0 -
That Sales Manager guy sounds like a right f*****g idiot. God I hate people like that. I would try and feel positive about the meeting you're having on Wednesday because:
1) You haven't done anything wrong.
2) You have a witness who's willing to say you weren't verbally threatening.
It sounds as though he's woken up on Friday morning thinking "Oh s**t" and has put the grievance in to save his own skin before you put in a grievance in about him.
I'd make sure your company knows how seriously you're taking this and that you're taken legal advice regarding the libel comments from him (telling everyone you're a drug addict).
Good Luck, what a shi**y thing to happen so close to Christmas.0
