Yes please but what's also important is the details of your original complaint to the bank and the subsequent complaint to the FOS. It's important we know the legal (and otherwise) arguments you put forward as it is likely the FOS are progressing or not progressing complaints that were based particular criteria.

If it helps you can e-mail any scans of letters to here admin@legalbeagles.info

Hi Alpine Star,
I know you are trying to help me, but I used the standard template that everyone used on this website and also advice on this website for the complaint form for the FOS - I think Martin had a template of what to write on it. I haven't got the saved copy on my laptop at home, but have at work.

Thanks crawli. What we need to know now is the basis for your complaints so we can identify why they are giving you this potential lifeline.

If you can find the identical template you used here on the site can you post a link?

When you say "basis for your complaints", what exactly do you mean?

I can post my FOS complaint form tomorrow when I am at work.

This site has moved on really fast since I put my complaint in with FOS, i wouldn't know where to start to look for it.

However, if there are individual factors or circumstances particular to you - or to the way your bank operated your account at the time the charges were made - which you feel should be taken into account, then please write and let me know by 31st December 2009, so we can assess whether they are likely to make a difference.
There is more information about our approach to complaints about bank charges on our website (at www.financial-ombudsman.org.uk/faq/bank-charges.html).
Yours sincerely

I think I will telephone them tomorrow and ask questions. It would be helpful if you Alpine or someone else on LB could do the same. I will post what I get on this thread.

Essentially the FOS won't be progressing complaints based on sec 6 of UTCCR and penalties. But the fact that they are asking you for information on ''the way your bank operated your account at the time the charges were made'' probably means you used additional arguments. As we can't introduce new arguments at this stage now, we can expand on your existing ones but we'd need to know what they are.

I suggest you post the FOS complaint form when you can and we'll deal with it from there. What would also be helpful is a list of the charges with dates as it is the application of the charges which may form the basis for the expansion of your complaint criteria.

Thanks Alpine - should I forward my original complaint form to the email address you put on this post earlier along with my list of charges? I don't know how to attach documents on here or can I do it in a personal message to you?

I feel that carefully targetted questions to FOS, has potential to be of assistance in developing our arguments.

Just been advised FOS not covered by FOI, pity that, but not impossible to circumnavigate.

They do seem to be offering some hope in their letter.

The opportunity could also be taken to lobby MPs to ask particular targetted questions at any forthcoming relevant parliamentary working groups etc or consultations.
