private parking ticket

hi all, im new to this site just a few minutes ago so please bear with me if i seem a bit muddled . my question is related to private parking. ie iwas parked on double yellow lines on private land ie aintree retail outlet.all the available disabled bays were full so i parked on double yellow lines near to the shop. i displayed the blue badges and accompanied my disabled wife inside the shop. when we returned to our vehicle there was a parking notice charge put in my wipers.i thought i was ok with my badges showing in windscreen but it seems not the ticket was basically telling me to pay ££100 or £60if paid within 14 days to ukcps. when i looked around i did see a parking notice but failed to see it when i arrived .my question is , is this still contestable or do i not have a leg to stand on so to speak.?

    Yes and no.

    Disabled badge doesn't apply to private parking. However, you will not have to pay up. Private parking fines are completely unenforceable. Just ignore any correspondance. They will threaten court action etc etc but they can only recover losses. Their loss is nothing.

    Bob is totally wrong, special parking bays have no legal standing and are basically graffitti. If you cannot be bothered to kick up a fuss then just ignore them.
    Don't Pay
    Don't Communicate
    Don't reply to any letters.
    Don't appeal as they insist on payment with the appeal. The chances of getting your money back are almost nil.
    You will get 5-7 threatening letters but pay no attention to them, all threats are just hot air.
    If you need reassurance later come back on here and someone(not Bobl) will help you.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
  • As said do not enter in any communication with them they have no power as the last writer says hot air ... see the below from a forum that specialises in these problems and thuggish parking criminals.

    Assuming you have disabled badge that your on benefits.
    article 187 of the Social Security Act 1992

    • Income Support
    • Tax Credits
    • Child Benefit
    • Job seekers allowance
    • Incapacity benefit
    • Disability living allowance
    • Attendance Allowance
    • CSA payments
    • Other DWP payments.

    These social security benefits are granted to stop hardship and are designed to meet basic day to day needs, and are exempt and are protected under the Social Security Administration Act 1992 sub section 187. from arrestment in terms of section 187 of the Social Security Administration Act 1992 (see Enforcement of Civil Obligations in Scotland, Scottish Executive report, at paragraph 5.245). Section 45 of the Tax Credits Act 2002 is an identical provision to the said section 187 of the 1992 Act.
    article 12 of the Bill of Rights 1689

    that all grants and promises of fines and forefeitures of particular persons before conviction are illegal and void.

    Reply to their NOTICE (offer) with a NOTICE of your own seeking CLARIFICATION

    CONDITIONALLY ACCEPT their OFFER of a fine, and you are happy to pay BUT only if they provide you with the laws that have repealled the above, that unequivicably proove to you that their issued fine is both LEGAL and LAWFUL because you would like to establish that your not being ripped off.

    Whatever you do... DO NOT SIGN THE TICKET, DO NOT SEND THEM IT BACK, AND DO NOT TICK THE DISPUTE BOX or your bu@@ered

    Google : NOUCOR FPN : and you will find template notices to use to get rid of this in one letter, if it doesnt work then you will have all the ammunition you need to win in court from their reply(s).

    Ensure your template letter includes the legal phrase : TACIT AGREEMENT BY YOUR ACQUIESCENCE... so if they ignore your NOTICE you also have all the ammunition you need to win in court. Ignoring a NOTICE that contains this phrase is their agreement to your UNDERSTANDING of the above statutes.

    Please look into this for yourself before trying so you have a better idea what your doing. Its not difficult to learn or hard to do. :)

    I will not be adding anymore to what ive said above and will not be adding more posts in this thread. Im not being awkward or ignorant declaring this.
