On Monday i was waiting at some traffic lights to go straight ahead the lights were showing red for me. They then turned to green for me to go i set of doing around 7 to 10 mph when a car drove across the front of me from my right i had no where to go and hit her off side wheel arch.
The lady stopped and admitted it was her fault saying she stopped just before the yellow box junction as she could not clear it then when her exit road was clear she in her words went for it but by this time her lights had turned to red. She rang the police but they said just swap particulars which we did. I said to her i will contact my insurance company to make a claim which she acknowledged and said okay it was my fault.

Three days later she has still not got into contact with her insurers and I'm beginning to think she is going to come up with some story and change the story of events. There were no witnesses to the accident everyone just moved on an ambulance did arrive as i jolted my back but i declined treatment and she even admitted to one of the crew it was her fault.

My insurance company have checked and said she is insured and her particulars were correct what she gave me. But now I'm worried this is going to drag on. At one point my insurer was unsure wheather to give me a courtesy car until she came forward.

If she does go back on her word of blameworthy where do i stand.

    If the car was coming from your right, you presumably drove into the nearside of the car.

    Anyway, details aside, what does a green traffic light indicate?

    Edit: how did you get an ambulance? Around here they won't dispatch an ambulance without also dispatching a police officer since the police need to be aware of any RTC that involves personal injury by law. All done in the same call to the emergency services

  • If you've hurt your back, report the matter at your local police station as an injury RTC - they will then contact the other party and ensure all her docs are in order and your insurance will have a better point of contact

    What does an amber light mean. What are the rules about entering box junctions what are the rules about driving through red lights.What are the rules about driving and not checking traffic lights and road signes.

    This box junction is a very large one about 25 metres in lenght so at morning rush hour in the dark chucking it down i looked right and proceeded it was only when i got in the middle of the road that this car came across the front of me

    You drove into the side of her which suggests that you didn't check that anyone was coming. You may find you're the one paying out or getting a 50/50 claim. Whilst she jumped the lights, she was already on the junction prior to the change and you clearly didn't check to see if anyone was coming and drove into the side of her. Usually that'd put you at fault.

    Not a court in the land would give her any benefit of doubt - if you're caught in no mans land on the edge of a yellow box, you can still see what your junction lights are on on the opposite side of the junction.If she's collided with a car coming from her left, it's her fault.

    I can think of a couple of junctions that have a yellow box junction BEYOND the solid stop line for traffic lights, i.e you could coinceivably pass a green light but not enter the box if the exit is busy, then when traffic moves you could carry on, even though the initial green light you passed is now showing a red.
    Is it possible this is what happened to the OP?
  • Regardless of whether the yellow box mark extends to the stop line or not, she should not have crossed the stop line if her exit was blocked (HC 176). Consequently, she shouldn't have been in the junction at all while red was showing for her traffic flow, and only an idiot would have raced across the junction when red is showing... If she hasn't come forward, does this not leave her open to prosecution, or at the very least affect the possible outcome of the claim?

    The OP doesn't make it clear if the person was turning right from the direction they were travelling in in which case, they were perfectly entitled to enter the box junction.

    All that aside though, the OP ran into the car, not the other way around so the OP is the one who is being negligent by failing to check if anything was coming. Don't know about your driving lessons but when I had mine, I was always taught to look right and left at a junction when setting off from traffic lights.

    You're saying its not her fault but it could have been an ambulance, fire engine or police car that was legitimately going through a red light. The simple fact is that the OP had blinkers on, was only concentrating on what was in front and didn't look properly.

    At the end of the day, the insurers will most likely sort it out but there's not many claims where someone has run into the side of someone else and won.

    What would happen if an emergency vehicle went through a red light (legitimately) and was involved in a RTA?

    If the exit is blocked, then NO, but if they are prevented from going right by oncoming traffic, or other traffic going right, then you are allowed to enter and wait within a box junction.
