I’ve seen people sell their contact details for cars or packaging for game consoles on e-bay and it goes for hundreds, and its obvious what the seller is selling, its misinterpretations or misread by the buyers or which cause this... it blatantly says what the user is selling, so the seller hasn’t done anything wrong!
I don’t know what it says on the description on the lot which the OP brought, but providing the description said whatever the OP brought, I don’t seem to think the seller is a “scum” as some users have said in this thread and has sold a legitimate good. If the buyer misinterpreted it, it’s not the sellers fault.
If it said he was selling a "Sany" phone in the title, then you are quite right, the seller has done nothing wrong.
If, however the auction title says something like "Do you want a Sony 999", followed by a load of hype about how good the Sony 999 is, followed by a massive cut and paste of the Sony 999 specifications, followed by a very small light grey on white "you are bidding on a Sany 999", then the guy is a scum bag con artist.
I don't doubt the Del boys of this world won't see anything wrongt in what he's done, but he has set out to deceive, and suceeded in his task.

agree Moglex, but we dont know what one he did... it may have been deliberate, but it may have still been a legitimate description, with which we cant complain to the seller. if stated like your thrid paragraph, then he's a proper del-boy! and diserves to be kicked!... have to see the auction to tell though0

Personally, i'd have disputed it with paypal (and risked the neg - although there's always a chance the seller wouldn't risk getting a retailatory one back and so it'd be left as a standoff). The seller has left negs before along the same lines: "Not a good ebayer buy something without read description at blames the seller." Firstly, I'd be surprised if the Sany "W800i" is able to do the same functions as the Sony W800i - and so there is misdescription. Then there's the fact that the seller induced the error. And then there's the intellectual property theft in question too. It's clearly a case of 'passing off' and i'd bring the matter up with Sony themselves, as they be interested to hear what's happening - the seller is clearly and obviously attempting to use some confusion of identity through the use of Sony's name and character and as a result is damaging the goodwill and reputation of Sony.
The seller was a complete chancer and it's a pitty the buyer felt the need to give positive feedback to avoid a negative remark back.0 -
Looking at the item now I am sure you can claim your money back from PayPal and/or eBay.

if you have not received the advertised "SONY" then you can indeed start a claim for item not as described.It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.
Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.0
