I would say these pictures are also evidence of unlicensed clamping, perhaps the SIA needs to be told?!

It never ceases to amaze me that people think just because they have a disclaimer that they can waive their legal duties and / or claim they are entitled to do things they are not.
His waiver "allowing" him the right to use reasonable force to gain entry into a car and advising he accepts no liability for any damage or injury in performing his duties. Is a blatant example of what the unfair contracts act is all about, you cannot get out of your legal liability if you injury someone or damage their property just because you have a sign saying you are exempt.
The disclaimer may as well say he reserves the right to deflower the vehicle owners RK for all of it's legal merits.
I also like the way the disclaimer applies to the Limited Company and the "Proprietor", there is no proprietor of a Limited Company, just employees and shareholders0 -
Now... If someone were to go to Avenham road and accidentally turn a screwdriver a few times and misplace a sign. :rotfl::rotfl::rotfl: Maybe put up a new sign with a disclaimer that signs referring to illegal practices may be removed, and directing people to the nearest tool hire shop to get an angle grinder.0

I also like the way he has put "Failure to ENDEAVOUR to make payment will result in your vehicle being towed away (Or reading between the lines someone may come along with a coat hanger).
Why would you put the word endeavour into that sentance as it changes the meaning of the sentance totally. Without the word endeavour that sentance would allow him to tow the vehicle away. With the word endeavour in that sentance if you have endeavoured ( http://www.thefreedictionary.com/endeavour ) to make payment and did not have enough money or could not get hold of PCN-UK (He might be doing a shift in the pound shop) then you have not endeavoured to make payment and he cannot tow your car away.
It's a great example of how one miss placed word can totally change the meaning of a sentance. I'd love to see someone use that in a court case to recover their towing charges in a court case against a PCN-UK. I would not be surprised if a judge ruled in the parkers favour if they can prove they did try (Endeavour) to pay it.
What are the bettings of another white sticker appearing on the signs once he reads this and gets someone to explain it to him...

Good idea, after all the SIA are the "regulatory" body. The clamper arrested, found guilty of assaulting my son twice, and allegedly assaulting a court bailiff serving writs, and selling "about ten cars a year" without title (admitted), and sentenced to 28 days in prison for six months contempt of court, and STILL has an SIA licence.
FOI Request for info from SIA refused as "mitigation" privileged personal information...............0 -
Did anyone find out if Avenham road really is private land or not?
Might be able to get PCN UK Ltd's final contract terminated if we can find out who the land owner is and point them in the direction of this thread and point out the info they'll get just by googling for "PCN UK"0 -
A few days ago I complained to Patrick Troy of the BPA about the misuse of their logo by PCN-UK. This morning I received this very illuminating reply:-
Many thanks for drawing this to my attention.
It appears PCN UK no longer exist and their website closed down. We have established though that the owner of that company has formed a new company and that company is currently applying to the BPA for membership of its Approved Operator Scheme.
While I think this deals with the point you are raising, is there a wider concern you have about this company or its owners? Do please let me know as it could be relevant to their application.
