    P.P.S What are the chances of negoiations between MSE and PCN-UK about the previous thread and the link to the MSE advice on private parking tickets

    Another clear breach of Unfair Business Practices

    Seeing as he monitors MSE lets see how long it takes him to change the website when he reads this.

    Ash's website refers that people are parking "Illegally", here is what the OFT regards as unfair with regards to collecting debts.

    False representation of authority and/or legal position
    2.3 Those contacting debtors must not be deceitful by misrepresenting their authority
    and/or the correct legal position.

    Incidently 2.8a is interesting when you through in the sending demands to the registered keeper of the vehicle when they may or may not have been the driver of the vehicle at the time of the ticket....

    2.8 Examples of unfair practices are as follows:
    a. sending demands for payment to an individual when it is uncertain that
    they are the debtor in question, for example, threatening debt recovery
    action to 'the occupier' or sending a payment demand to all people sharing
    the same name/date of birth as a debtor in the hope that contact with the
    correct debtor will be made.

    OK, enough is enough. What steps to be taken to close this chap down?

    Bottom line is whereas we (appear) to have a little knowledge, others don't. This clown is making money wrongly from a lot of very innocent people.

    I despise this sort of person. He is unlawful, tacky, cheap and an utter disgrace to humanity. there is a principle in law called locus standi which means that only someone who is affected can complain. I'm not affected - just annoyed.

    In my view, we need to find a method of putting things right in this situation. My hopes that the "great" journalist Martin Lewis would put some publicity behind this sort of thing have been thwarted before so no hope there.

    Any suggestions?

    Given the level of mis-information on the PCN-UK Ltd (or PCN-UK Limited) website, surely Trading Standards should be able take some sort of action?

    I'm gonna ring Trading Standards on Monday and see if they're aware of him.

    I see dr-who and all his posts have disappeared LOL.
    Be on your guard guys for another newbie appearing and posting stuff to get the thread locked.

    Regrettably, despite what you might think, TS are
    a) not interested in ppc's unless one of their own bigwigs get clamped.
    b) generally are totally misinformed and will tell all to pay and then appeal.
    c) are not bothered if a website is misleading, unlawful or wrong and possibly do not have the remit to do anything even if it stares them in the face.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

    Technically the local Trading Standards branch should investigate websites which breach the Unfair Business Practices, as it's a fairly new law they do not always invoke it and a lot of the public are not aware of it so do not report breaches.
