But they do have a 12 month manufacturers guarantee, it's not Argos's fault that it's not worth the paper it's written on.
If Argos sell me something with a 12 year guarantee that turns out to be faulty after three years, how can it not be their fault. The item now 'fails free from defect', 'durability' and 'as described' requirements of SoGA. It is certainly not my fault that it isn't worth the paper that it is written on, so why should I bear the cost?
Tomorrow I can either paint the sun room or spend the entire day moving this forward in the correct direction. I hate painting, so tomorrow would be a good day for a sickie if you work in Argos 'customer service.'0 -

But Argos ARE fulfilling their legal obligations under the SOGA, the warranty is nothing to do with them its with the manufacturer.
Argos have told me this morning that they are monitoring web-sites I wonder neilmcl?
I bought a product which had a fault from the moment I bought it the fact that it has only come to light now should not have anything to do with the refund I get. The refund should at least be based of the life of the product which according to it's manufacturer is 12 years not 6.0 -

You clearly don't understand the SOGA then. And no, I don't work for Argos or any other retailer for that matter.
neilmcl, SOGA states that you can pursue a claim for 6 years this does not mean that the life of the product or the refund you get should be based on that time frame. The refund should be based on the expected life of the product Argos are claiming that is 6 years I am simply stating that as the product was originally advertised on their web-site as having the wooden parts warranty for 12 years that this is what I feel they should base their refund on.
The process of getting a refund is something that is negotiated between parties and if the can't agree on a value the judge in a small claims court will decide the value.
I would urge everyone to negotiate with Argos of the amount they are offering as a part refund0 -
The extent of liability for a seller is 6 years max which is all they would be required to base a partial refund on.0

Do any of you have the original Assembly Instruction Booklet, it was a thick A4 Booklet "Adventure Playsets" Amarillo Texas is where it is from. And it proudly displays "Guaranteed for 12 Years" on the front. We bought Tacoma II playset, and like yourselves, have been offered £133 to replace it, received the call from Argos to collect it, refused this over a telephone conversation and was offered The Meerkat (£374.00) equivalent.
Problem is, in January last year our 3 year old fell some 7ft when one of the monkeybar rungs snapped/rotted away. He hurt his hip and leg but not so badly that it needed hospital attention, he was terribly bruised and really frightened, we have 3 boys who up until that time played on this set throughout summer and winter! We contacted our local argos branch where we made the original purchase, the manager at the time was useless and told us it wasnt his problem, how I wish I'd taken photos, recorded discussions etc. He told us to go back to the manufacturer (in Texas!) we did this, they were very apologetic and sent us new monkeybars within 10 days. We were so impressed at how helpful they were, until we googled Adventure Playsets and saw that they had had tonnes of complaints and injuries caused on these products, we were mortified. But at the time felt nothing could be done and that we were the only ones going through it.
When the letter came before Christmas we called Plum, they said they would send more monkeybars out. then came the letter last week.
I have tried to call the number supplied for Argos - 01785 710248 but it just rings to answerphone and no message is ever returned..... what now?
I am prepared to fight this all the way, I want a full replacement, yes I might have had the product some time but it is guaranteed 12 years, it has been maintained and cared for so why should my boys be without their toys which I could ill afford to pay out for now given that the equivalent is some £800.00!
Whose with me? are we taking Plum/Argos/Adventure Playsets on?!0 -
Neil, let's say, for example, you bought a new car at a cost of £15,000 with a 5 year warranty from a company in the UK. 13 months on and the car deveops a fault and is recalled. The company you bought it from says 'the car is being collected, we'll give you 8k for it as you have used it for a year. Ah, ha, you have a 5 year warranty, you'll get it sorted on that. But then they tell you sorry, we are based in the US, tough, you have to take the 8k being offered.
Surely you bought the car expecting it to be more or less fault free for 5 years? Would this be acceptable??
The same applies, if you want a play set to last 2 years then you spend £100 on a cheap metal one. I spent £1,000 on my childrens one 18 months ago (thankfully NOT AP) and expect it to last the 10 years the warranty is for - I'd be furious if they told me that it was tough, the warranty does not apply because the company is based overseas and yes, I would be expecting a like for like replacement - that is what a warranty is for.
I would be writing to Plum and Argos and outlining what you want and failure of them to replace it like for like will result in Small Court actin - then it will be down to the judge to decide.0 -

I am sure neilmcl is not neutral Argos also told me that they are aware of these blogs on the phone yesterday before eagerly rushing off.
I have been offered the same embarassing £111 refund maybe to allow me to trade my well looked after 3 swing monkey bar climbing frame for a single steel swing (as this is all that this will buy nowadays) or the Meerkat (that compares with it simples !!!) which I was told retails for over £369 unless you buy it from Argos now as it is reduced (therefore a hefty markup on this I am guessing).
On the phone they were rude eager to hangup, no time for customer service and the lady from the Directors Office very abrupt.
I am planning on writing to Argos to see what else they have to say or at least waste some more of their time (as I notice that this hasnt been very useful in other postings <-- are they that arrogant and feel that there business is that good if I was you the watchers of the blogs I would be embarassed to be associated with such a company), then after this lets hope Watchdog will be interested as I feel that this item should never have been on sale by them through lack of safety standards.
One thing is for sure they will not be getting my playcentre until the Meerkat is in stock. They want these back to get final agreement and then customers will have no other comeback if offers are changed at a later date also little comeback if the demand on the Meerkat is so high and they cannot fulfill there end of May delivery.
