Yes , I understand SOGA, my issue is purely this. Argos sold me a climbing frame with a 12 year guarantee, used it as a selling point and it has been looked after correctly. My children used their savings to pay for it, if Argos want to use the guarantee as a selling point, morally and I repeat morally I think they have a responsibility. Yes, I too could modify a Meerkat, is that after I have wasted a weekend taking this one down and rebuilding the new one.
What are Argos getting back from Plum? suspect they have a deal going as they are still selling their products? Are they getting a full refund ?
Oh , final point, this issue was raised in the U.S.A in 2006, long before some of us bought these things.
I am fortunate enough that I could go a pay for a new one, my issue is purely on customer service!
I am going today to buy my boys a new T.V each from another store, read this Argos so far with my youngest's birthday last week you have lost at least £300 of my business, today that will at least double.
Remember the old saying, treat a customer well and they may tell someone, treat them poorly and they will tell everyone.
Sort it out Argos, summer is coming, 4 and 7 year olds don't understand the SOGA!

Am I happy with what I have been offered - bearing in mind I'll have two swings, a slide, overall improved longevity, AND a playhouse on stilts after an extra days work. Of course I am.
Is my time free? No, it's not, but are you seriously suggesting Argos should pay for your time in constructing a better playcentre?
Did you approach them to ask for a discount at the time of purchase, due to your valuable time being wasted assembling the product?
I suppose you could get a quote from a handyman for the work. Go for it. Try and claim for that too.
Are you going to claim for the time taken to process the claim, mental anguish and stress? Book the GPs appointment now - you can probably get a month off work on the strength of dealing with argos customer services, but is it really worth the extra hassle of repeated complaining?
Think of it this way - I'm a parent. When I'm eventually a grandparent, my kids will go and try and buy swings for THEIR kids. And I'll bet they'll either find swings were outlawed due to blaim'n'claim ambulance-chasing solicitors closing companies down due to kids getting splinters, or the swings are too damn expensive, as they're all tested for 12 years before sale, have insurance-backed guarantees, and include professional installation and an annual service and inspection carried out by trained professionals.
You bought some cheap and nasty swings - trust me, really, they're absolute crap. But they were cheap, looked nice enough in the pictures in the catalogue, had enough swings for my twins, and with a few coats of cuprinol may have lasted another couple of years.
A 12 year guarantee on a wooden structure that's home-built, and supposed to be home-painted every year would never, ever, include complete replacement. You'd get new bits, when you claim for broken or rotten parts - so it'd be your time again. You built the original one - so it's down to you to fix it up with new bits when it breaks. At least this way you get complete replacement with a much higher quality item.
There comes a point when I really start to wonder what this country is about, and what sort of businesses will be around in a few years. Trust me, argos won't be selling playcentres they can get sued over - it's not worth the hassle - they'll stick to imported chinese electronic crap.
Options..
Take the meerkat - its way better built, which is why it's smaller, for the same money.
Take the frankly pointless 'compo' payment - its not enough to replace the swings, but it's legally correct, so sue for more, over and above the legal requirements set out in law, and see how much of your time is wasted then.
Get something else from argos. Job done.
Sue, stamp and scream. Time wasted, blood pressure raised, and a few extra quid. Maybe.

All well and good for you but what about me,i had the durango and im not after money i just want like for like.I have a trapeze a swing and a seesaw swing which i purchased separately for my durango.I also have a covered fort and a mini rock climbing wall,so are you telling me that the meerkat is an adequate replacement,well i dont think so, so ill be taking this as far as it goes to make sure my kids have the exact replacement as what i paid for 4 years ago

Perhaps a more realistic life expectancy is six years... as you have had the use of the thing for four years, you are only due a refund of, at most, one third of the price.

Surely you understand that the manufacturer and not the retailer is responsible for that guarantee?
As you say, you have had four years use.
You have not told us how much the retailer (assuming Argos) has offered you.
If it is less than two thirds of the purchase price, you may be able to pursue them for more.

If, however you wish to go after the retailer using your statutory consumer rights, don't be surprised if they only offer a partial refund based on any usage you've had. Now, rightly or wrongly, Argos seem to be arguing that as there is a limit of 6 years for claims under the SOGA, that is the extent of their liability and will work out the refund based on that. If you don't agree then you have a relatively simple route to take, go to the Small Claims court and seek a judgement!0 -
