Spoke with HBOS on Monday. said they would be working on my case on that day and would call me. Still waiting..... How long does it take?
In my job I meet people and I know for a fact that HBOS are calling customers on a weekly basis chasing people who have missed a payment on a loan. I have been chasing HBOS for many weeks over the eight week limit and we are heading towards the end of the road as far as my patience is concerned. If they have backlogs its not my problem and I feel it is time (not to go to FOS as they suggest in their letter) to commence court proceedings to recover my loss. I will be calling them once again tomorrow and will keep you updated. NeKo
be very careful before you start court proceedings - as the loan was taken out in 2004 it may be outside the 6 year time limit under the Statute of Limitations - if that's the case HBOS's solicitors can ask for the case to be struck out and you could be liable for the othersides costs !0 -

Who are the Freemans insurer and when did you take the policy out?
It was a requirement of the GISC code that its subscribers only accepted business from/referred business to other firms which also subscribed. Therefore, if the insurer was a subscriber and had accepted an application from a non-subscribing intermediary, you would seem to have grounds for complaint against the insurer - which would now be covered by FOS.
With HBOS - go to FOS now because it is free. It may take some time but if you win it is legally binding. If they don't pay up you may have to go to Court but if you have a valid Ombudsman's award then that is a debt which arose on the day it was made - and the six years to go to court starts from then.0 -
HBOS have upheld my complaint and will make payment of refund within a month. I don't have a figure as yet but the details of how the refund will be calculated look promising.0

Many thanks for the information re Freemans. The insurers are Assurant Solutions who are regulated by the FSA. We have no idea how long the PPI charges have been applied to the A/C. After passing this onto the FOS we recieved a letter from the insurer advising that it is not their responsibility as it was Freemans who sold the policy.

Take the complaint to against the insurer to FOS arguing that they were prohibited, under the GISC code from accepting the business from Freemans if Freemans was not a subscriber to the code too and that, by breaking the code, they have denied you the protection to which you were entitled.
It is possible they didn't subscribe either but still worth a shot.0 -
I started this argument with FOS a long time ago and won with it but only for unfair rebate but i did have talks with this manager about misselling there who said they were now taking complaints against insurers. HBOS have refunded 5K+ in respect of miss-sold ppi on a capital bank loan. Anyone know about tax to be paid on the interest payment?
The case on the preference a/c is still with their redress team and its dragging on. I have been chasing this on a weekly basis but they say the calculations have to be done manually and it could take another month due to the backlog. I had the a/c since 1978 so they have a lot of work to do! I'm not very happy that its taking so long but I guess I'll just have to keep chasing them on a weekly basis like they to to their borrowers who have missed payments. I did send a letter to their CEO complaining about the delay but never received a reply. brgds NeKo0 -

FOS have obviously written to the insurer and we recieved a written response from the insurer stating that we should take our complaint up with Freemans which we did beforehand. I am not sure if the FOS will have taken it any further and I will have to follow up on this one. NeKo0
