PPI Info and Queston

Hi all and thanks for a first class forum.

Currently written to HBOS re. miss-sold PPI on a personal loan taken with Capital Bank in 2004 and PPI charges applied to a BOS Preference Account I had running since 1983. After about a week I recieved a call to discuss the problem further which they have agreed to investigate and requesting further documentation for other loans which I (no longer have and told them so).
Today,, another week on I decided to place a courtesy call (as they do to us all) for an update quoting the reference number. Was told that there is no update, the matter is being investigated and quoted that they do have 8 weeks to do this....so I left it at that. I will be keeping up these courtesy calls on a weekly basis as they did to me trying to encourage me to borrow more money and drive me deeper into debt..
BOS Enclosure says "Here's what well do" "If you have a problem we want to fix it quickly and simply". What could be simpler than refunding my money which they have deprived me of over many years?
If I called them and wanted to borrow 10K it would take 20 mins (and another 30s to miss-sell me the PPI) so why should this refund process take so long?
I will keep you all posted how matters progress on this one.

At same time of writing I also drafted a letter to Freemans on my Mrs behalf as she has also been miss-sold PPI. She got a reply within days fobbing her off by stating they were not regulated at time of introducing PPI etc etc At the timne of becoming regulated I would have expected them to carry out a review of all their customers at that time to ensure they were in compliance but it seems evident from their statement in their letter thatr they have failed to do this.. Sent more detailed letter in reply clearly stating reasons for miss-selling of PPI giving them 8 week deadline and they are now taking their time to reply as have not had anything back in the last week.
Will keep you updated on this also.....

Now for my question. Does anyone have any knowledge on RBS Mastercard? I have had Mastercard for many years and after studying recent statements I cannot find any reference to PPI charges. I find this strange that while any other card I have had has managed to show charges for PPI but in this case there is nothing. Does anyone know if Mastercard have been known for applying hidden costs for PPI and does this require further investigation? I have tried several Google searches on the subject but cannot find anything. Does this mean that Mastercard are one of the better CC companies who do not miss-sell PPI to their customers which would explain why I cannot find any reference to such on my statements or otherwise?

In all of the above cases the accounts go way back but it is my intention to pursue this to the fullest extent.

We have been deprived of £1000's of our money over the years by these people and will settle for nothing less than fully accountable refunds with interest to compensate for what has been lost.

It is OUR money and all I am asking for is to have it back. If it means standing up in court and asking for it back that is what I will be doing as I now know I am in the right.

How sad it is to see so many of us with "MUG" written on our foreheads in this twisted world of financial professionals who we are supposed to trust and rely upon for sound advice.

    Hello Neko and Welcome.;)

    Wishing you luck with all your reclaims, if you hear nothing by 8 weeks them move on to the FOS anyway.

    Where the business were not regulated/governed by GISC when taken over by the FSA in Jan 2005, the FOS are not usually able to investigate complaints if they were not covered at the time you taken out the finance, but another way around this is to pursue the actual insurer instead. where these were covered.

    I had this problem with one of mine and the FOS sent back my complaint, so was advised to take it to the insurer/underwriter as another alternative, and finally the FOS have accepted this and is now waiting to have this case passed on to an adjudicator.

    Anyway, its up to you but maybe a Subject Access Request (SAR) will be a good idea if you have not done this yet where their data dept should send all the info they hold on your account(s) you've had with them.
    There is a £10 postal order or cheque payment request for this, and they have 40 days max to comply.
    Template SAR letter here below link and post by recorded delivery, this is your proof of posting.

    Thanks for reply and info.
    If I end up getting a negative response from HBOS after 8 weeks I will go direct to FOS as I have provided them with a copy of a 2004 credit agreement where I was miss-sold PPI for over 3k plus interest.

    I also have statements from BOS Preference Account which clearly indicates monthly deductions for creditcare insurance which I have no recollection of agreeing to. In the earlier days this was called a paymaster a/c and at some point it was changed to preference. I certainly have no recollection in entering dialogue with a salesperson to discuss whether I was suitable for PPI, whether I already had PPI in place, whether the policy was necessary, my employment status or otherwise. All I have is a Bill Protector policy dated 1st Sept 2000 on file for a monthly premium of £5.99. and for whatever PPI was applied to my loan over the years, I was not subjected to any sales procedure to ensure that the policy was suitable for my needs considering my then employer guaranteed full wages for first 6 months of illness then reduced to half wages depending on a review.
    Considering the aforementioned, had a proper interview taken place I would not have met the criteria for PPI. I can also provide evidence of this from my former employer along with an account where I was off work for a long period due to a serious car accident and it was not necessary to attempt to claim compensation. Whether I was duped into ticking a box on a form, the seller did NOT follow any sales procedure to determine if I was suitable to be insured.

    In the case of the credit agreement,, this was conducted over the phone, all I was sent was forms by courier to be signed, no tick box for PPI although it was quantified on the form. All I signed was the bottom line. Perhaps I should have studied things in more detail at the time but you know what its like when a courier is looking over your shoulder and chomping at the bit to get a move on.

    I have found that some banks are not following their own complaints procedures properly, it is worth studying their procedures. If they do not follow their procedures it may help your case when it goes to FOS.

    NeKo - can't advise on anything but your HBOS but I found them really fair & although they did take just a bit less than the eight weeks they upheld a cc from the 80's & a loan from the 90's for me. Hope this gives a wee bit of encouragement

    Thank you all for your feedback and information.

    Had a second letter from Freemans a couple of days ago.They have reconsidered and their final decision is that there is not a case. I have spoken to FOS regarding this and they confirmed that they cannot deal with this one.

    I will now take this matter up with the insurer as di3004 has suggested.

    Does anyone have information on the insurance company for this service and their contact details.

    Hi Neko
    Freemans should be able to let you know these details, give them a quick call, tell them you require this for personal reasons.;)

    If not write to them and ask if they can send this out to you 7-14 days as from the date on your letter, good luck.

    I Like your post - & feel exactly the same, & I feel empowered thanks to the help & encouragement of so many on this site to go after every last rotten charge.
    RBS Mastercard - I had one many years ago & see that there is a monthly charge of £8.50 called Stonebridge RG Pament , which presumably is their ppi- like other posters have suggested I have sent in my SAR & am awaiting their reply.
    Hope all goes well with your claims.

    Contacted Freemans today who managed to give me the name of the insurer. They couldn't provide the contact details and suggested I do a Google search for them. I found their details, gave them a call explaining the situation and they agreed that someone would call me back later in the afternoon. They did return the call advising that it would be recorded. They claim that they are not responsible as they did not sell the insurance even although it is their product and they are regulated by the FSA.
    I'm now going to seek further advice from the regulators tomorrow.
    If there's no light at the end of the tunnel after speaking to them I'm going to write to Freemans once again demanding full refund of monies within 14 days or I will commence Court Proceedings.
