Contacted Freemans today who managed to give me the name of the insurer. They couldn't provide the contact details and suggested I do a Google search for them. I found their details, gave them a call explaining the situation and they agreed that someone would call me back later in the afternoon. They did return the call advising that it would be recorded. They claim that they are not responsible as they did not sell the insurance even although it is their product and they are regulated by the FSA.
I'm now going to seek further advice from the regulators tomorrow.
If there's no light at the end of the tunnel after speaking to them I'm going to write to Freemans once again demanding full refund of monies within 14 days or I will commence Court Proceedings.

    Hi Neko

This is a normal reaction from the insurers.

I would actually contact the FOS about this and ask if they are able to help by writing to them on your behalf, if a letter is sent on your behalf by the FOS, the chances are then they may not try fobbing you off.

Give it a go Neko, good luck and please let us know how you get on.

The FOS have actually taken on one of ours and is now waiting to be seen by an adjudicator, and this is the insurer/underwriter, before this we also received the same response as you, so keep at them.;)

    Many thanks for your reply,
I will ask them this tomorrow and if they are prepared to do so I will wait. If not I will consider to have exhausted any options and commence with court proceedings.
I wonder if my legal insurance will cover the costs for a lawyer. I'm not really bothered to be honest as i'm prepared to foot the bill myself win/loose.
I have some close friends in the media and will do my best to ensure some coverage on the outcome if it goes to court.

    Hi Neko, your welcome.;)

Wishing you luck with this and yes if you decide the court action, check your legal insurance, most of them do protect for this but check first, otherwise we are here to help you through this, good luck.;)

Have discussed the matter with FOS and they have agreed to investigate as the insurer is regulated by the FSA.
I will keep you updated on this.

Called HBOS today asking for an update.
"They are still trying to gather paperwork together and there is no update".

Since last posting I have been phoning HBOS on a weekly basis for updates. While this has exceeded the eight week limit they say they have a backlog of cases, this is going to take longer and they cannot out a time scale on things. I told the lady that I wasn't very happy quoting an example that if she had put her car into a garage for repair and they couln't tell her when it would be ready,, how would she feel about it. while she couldn't see the relevance I managed to pin her down to stating that it would be weeks rather than months before there would be a decision. She did advise that I was entitled to take this to FOS but I told her I will leave this option in the meantime and contact them on a weekly basis to discuss progress.
Do you think I should just go ahead and log this case with the FOS?
Perhaps I am being far too patient.

    Hi Neko

Sorry to hear your still waiting.

They have had more than ample time, so I can personally understand your frustration, even though I am aware that all banks have backlogs of complaints etc to deal with.

There is nothing wrong with chasing them up every week, and/or maybe give your own timescale now, if you hear nothing say by about 2-3 weeks deadline then move on to the FOS.

Hope you hear something soon with a good outcome, fingers crossed.;)

Spoke with HBOS on Monday. said they would be working on my case on that day and would call me. Still waiting..... How long does it take?
In my job I meet people and I know for a fact that HBOS are calling customers on a weekly basis chasing people who have missed a payment on a loan. I have been chasing HBOS for many weeks over the eight week limit and we are heading towards the end of the road as far as my patience is concerned. If they have backlogs its not my problem and I feel it is time (not to go to FOS as they suggest in their letter) to commence court proceedings to recover my loss. I will be calling them once again tomorrow and will keep you updated. NeKo

    OMG, your still waiting?
    What is going on there?

Try to find out who the Chief Executive is and tell him or her your intentions if this is not sorted out by 14 days.
    Good luck.
