e-machine e625 laptop

i bought a laptop from john lewis on 1/10/09. it has hard drive failure according to john lewis technician and they want me to contact manufacturer to arrange a pick up and take away for repair. what are my legal rights on this and could i ask the store for a replacement instead? as its only two months old . thanks for any reply recieved

    Hardware failure after two months? Not fit for purpose. I would be insisting on a refund. What is in their Terms and Conditions?

    I'm sure 28 days refers to the time when you can change your mind. Goods that are not fit for purpose are probably covered under another law. I would ask for a refund.

    They are covered by the sale of goods act.

    Highly unlikely they will get a refund as they have no legal right to one (or to insist on it anyways).

    You can only insist on refunds when you "reject" the goods, this is usually in a matter of days....

    As the op has used the laptop for a prolonged period (not just tested it out), they have "accepted" the goods and can now go through the motions of claiming their statutory right to a refund/replacement/refund/partial refund. This is not up to the OP though. It is entirely up to the retailer what they do and how many times (within reason)
    Back by no demand whatsoever.

    OP, what is your objection to a 'repair'? If the hard drive has failed then they will replace it and reinstall the OS, end of story. Hard drives are not repairable. The machine will then be as good as new.
    It's not like say a washing machine, where they might try to fix a fault only for it to fail again. New hard drives do sometimes fail, although it's rare.
    If you bought a new car and the engine blew up within 2 months, you would probably accept a new engine rather than expect a new car.
    No free lunch, and no free laptop ;)

    Agree with macman, though at the same time I would be unhappy with a laptop that failed in two months.

  • i am not objecting to a repair as long as its done before christmas as my son uses it for his course work at school.
  • at the end of the day its the retailers problem not manufacturers as i bought it from them but they keep asking me to contact manufacturers to sort problem out ! at the end of the day the soga says my dealing is with shop not them !
