Am I right to keep my tax disc

I am buying a used car from a dealer. The car I am buying has only a couple of months tax left on it. The car I am leaving as part ex has 11 months tax as i have only just renewed it. I never discussed tax in the deal. Am I right to keep my tax disc and claim it back for myself

    Yes, if you never agreed to sell it will the car.

    Agree with mikey72. You can claim a refund for every full month left on the disc. That can be a lot of money these days.
  • Grey area:

    As a seller i would argue that it is mine to keep as it has not been specifically included in the price of the car.

    As a buyer i would argue its included. As is the MOT, CD player, Spare wheel, Spare keys etc whether or not they have been specifically discussed or not. Afterall you wouldn't be happy if i kept the tax disc out of your new car.

    The way i always solve it to see if they've factored it in. Take the disc out of the window when you drive in. If they ask about it which they sometimes do, i'd simply say something along the lines of the following.......
    "If you valued my car including the tax disc can you tell me when it expires and how much it is worth?"
    If they know the answer i'd give it back, if they didnt then hard lines.

    When i used to value you cars i used to write the amount and expiry date on the appraisal form. However i would also let the customers that i'm including it in the valuation.

    I tried to edit it, but it wasn't playing ball and ended up deleting it by accident. Too late to fix it now since you posted.

    There was no mention of tax in the discussions I had. If they were giving me a years tax then I would have left it in out of goodwill. However as there is only a couple of months left on the newer car I am buying I thought that was fair enough. I cannot see anything written on the agreement.
    I just wanted to see if it is cheeky to take the tax away for my own good.

    Oh another point. The salesman only asked me to leave things in the car that i wouldnt need anymore, like locking wheel nut, manual, spare accessories etc. Is tax classed i something that i wouldnt need.

    Take the disc. it's likely that the garage will cash the disc in themselves before the car goes to auction if you don't take it.
