Fed up with broken phone

HIya,

I got a LG KS360 from play.com at the very end of March this year. It was always a bit iffy but I just really decided to ignore it to begin wiht. It broke completely at the end of September time where it turned itself off and wouldn't turn back on or charge. It went back to the manufacturer to get fixed and was returned with a note saying that it had had a new battery put in and a firmware upgrade. It worked okay until about 2 weeks ago when it started turning itself off again. It now will turn itself off when Im speaking to someone and also when I start writing a text message - as it is pretty much a phone designed for text message you can guess how frustrating this is!.

Anyway I'm pretty fed up with the phone now and I'd like a refund for it but where do I go? LG say I need to contact the retailer. Play.com say they have a reciprocal agreement wth LG for sending back faulty items but I need to contact them to get a code (ref number). LG say this is rubbish and that I need to contact the retailer or send it back to their designated company who fix their phones to get it fixed. But I don't want it fixed for it to come back broken AGAIN. I'm really fed up with this and could do with some help as to where to turn next.

  • Afaik it will be the retailer who is responsible for providing the remedy to the faulty handset under the SOGA but they, not you, have the right to decide whether they repair/replace or offer a partial refund.
