No because they wont have taken the money from the bank. It will be "reserved". There is a difference. Unfortunately most of those who endlessly buy these misprices dont understand this any better than the law.

YES as of last night my money stopped being a pending transaction and moved to being a transaction, thats money no longer reserved, money taken,and showing on outstanding balance no refund, all confirmed by my credit card company, of course i know the difference, i dont make stupid pointless, not looked into posts! maybe you might like to note that before you think people are stupid, this is what all the fuss is about!!!! had they taken your money and thats taken not pending would you sit down and take it? me thinks the answer is NO how very rude of you to presume! but then again looking back at your previous comments i should have expected a reply like that from you0 -

I cant believe how many people post on here with the same problem thats answered on the same bloody page. Read the first page and every case is the same, at least to the outcome, NO YOU CANT HAVE THE GAME AT THAT PRICE.

Bragging what are you on about what part of my post seems like bragging to you then? i never stated i was going to get this game,i posted up my situation to help and inform others who WANT to know whats going on,because it affects them,thats the point of this thread
if you could be bothered to read the post properly you would note that the delay is not from me or anything i have done,written or said but from tesco!
i answered to a poster who presumed i didnt know the difference between pending and taken from my own bank! and thought like yourself he could be rude

Yes they shouldn't have taken your money, however you can't use this to prove contract completed, and taking money doesn't mean that a product has shipped. They have not performed as per their T&Cs, however even with this breach you are still only entitled to the money back.0 -

at last someone who is not rude in their reply;), thankyou,yes i know i will only get my money back, this actually stopped being about the game along time ago, really when tesco had taken my money, and actually wouldnt admit they had, even though i had proof, trading standards told me they have broke the t and c's and are not supposed to, but they have,they will look into it for me and others who have had all this trouble
my main aim is to get a refund, maybe hard for me, as tesco wont admit taking the money! i have to give them reasonable time to refund(14 days) then put in claim, for the refund. i never intended to pursue a claim for the game via the contract completed avenue, but was very interested in whether or not there had been a breach by tesco, as this would aid my claim for the refund
