  • Just to correct another bit of incorrect information on this thread - the 24 hours is simply not true. A retailer can refuse to sell anything to anyone without any reason and can then immediately sell it to the next person in the queue if they see fit.

    It would be completely rediculous to expect a retailer to have to stop selling something for 24 hours due to them simply mispricing an item! If you point out a misprice in a supermarket you don't ever see hordes of staff emptying shelves of the mispriced goods, they just get a new ticket ;)

  • I too experienced this issue with Left 4 Dead 2, instead of re-iterating the same point, I was just wandering if they had taken payment from my card (and still haven't refunded me), would I have more of a leg to stand on for trying to get the game at the price they sold it to me for?

    I'm guessing that sadly I probably won't, but will be entitled to a full refund, with the additional £2 off coupon (more than likely I'll spend this on phoning to get my money back).

    I just needed to let off a bit of steam regarding this, their replies of "You have not been charged for this game" and "Price Promise
    The price you will be charged for pre-order items is the lowest of the price when you placed the order and the price advertised on the website on the day of release. " just wound be up, I was expecting to come home to day to let off some steam on the undead......Now thats all focussed towards Tesco, grrrr.
  • I too had the same experience as many, many others out there on the interwebs.

    Made my order on Sunday, it was cancelled on Monday.

    Figured that was that.

    Today I discovered that they have actually taken the £15 (ie. incorrectly advertised price) on the 2nd December.

    I telephoned their customer services and was told that a refund request had been put through on the 1st December. (ie. The day before they actually took the money)

    When I questioned them about honouring the price they said that the contract was not complete until I had received the goods (which, obviously I wont as they cancelled the order). Even though I said, 'well look, you've taken the money' they insisted they did not have to honour the price and that a refund would be made.

    Is this correct or are they simply trying to cover their mistake?

    If I do have a legal postion on this, does anybody have any suggestions what I can say to them?

    I would much rather have the game for £15 than have no game and my money refunded. :)

    No you have no legal position

    there is no contract as per their terms until they dispatch the game.

    I suppose reading the thread was too much hassle?

    The other thing to point out is they are not in the UK (ie Jersey) that would just make things even trickier if you wanted to chase them.
  • Yes I did read the thread and as nobody had actually been charged money like myself I thought it was fair question to ask.

    The poster above me, hypothetically posed the question of money being charged but had received no reply to his question.

    Also, in another posting in this thread (which I noticed when I y'know, read it) someone said the following:
    "Only when money has changed hands, does the order have to legally be fulfilled at that price."

    Again asking for clarification or advice seemed like a reasonable step in trying to understand my situation better.

    I apologise for ruining your day with my stupid posts.

    many people have been charged myself included, as yet no refund, i got on to consumer direct, tesco are only allowed to take money on dispatch and their t and c states that fact, if they have taken money IE: its not pending anymore they must refund you but they have also broke their own terms. consumer direct have passed it on to trading standards, i advise you report this as many have done this, you wont get your game but tesco entertainment cant just go into peoples banks like this, i have heard one story where they took the £15, then refunded the same day only to retake the money the next day, ive also heard of people who got the game yet have not had a penny go from their account! i dont really think tesco entertainment have a clue what they are doing on this one, and incase anyone thinks im moaning cos i didnt get the game thats not right, im moaning because tesco have my money, have rang cc company who state no refund as yet either! just think of the interest that they would make on everyones money in just one day! if what i heard was true and literally thousands of orders were placed:rolleyes:;)

    They are NOT a UK company.
