tenancy ending - irreconcilable differences?

    Take whart you can prove is yours, Write the rest off to experience and move out but before you do pop a fresh fish under the kitchem cupboards or behind the cooker

    Why not get the deposit from the landlord? He sounds like he's trying to stay out of it, but as relations with other tenants have failed you will not be any worse off.

    There are some real tenancy experts on this forum (I'm not one), but I though there were all sorts of tenant protection laws as far as deposits were concerned

  • Just take what you feel you are entitled to. If the others have a problem with that then I am sure they will tell you. For the sake of £100 it is not worth getting in to issues, especialy if you are going to be on the same planet with your house mates. Good luck . . .

    The *LL* is responsible for the return of your tenancy deposit and only he may make deductions, which you have to have agreed to. Ask him to come round a couple of weeks before you are due to go and agree with you what needs to done about holes in wall etc. Get confirmation in writing.

    Is this tenancy deposit scheme -registered ( assuming property in Eng/Wales)? If yes, have you been given the scheme's "prescribed information" and does each Ts name appear on the documentation? Do you have your own receipt from the LL for your share of the toal deposit? Was a "lead tenant" agreed by you all?

    Is the T at the end of a Fixed Term? If it isn't and the T is one with joint & several liability then all parties have to agree to one party moving out.

    tbs624, in answer to your questions:

    The tenancy deposit scheme details were never given to us (but I think the agent was at fault not the LL). The tenancy agreement had all three names on it. WRT the deposit, I believe I have a confirmation email of receipt from the agency who handled the deposit. There was no assigned lead tenant but I took on the bulk of the responsibility since the other two either didn't have a clue or took absolutely no interest in trying to sort things out (all bills are in my name, I solely dealt with the agency and LL and I negotiated a rebate of 2/3 of original agency fees because they were incompetent).

    The T is not at the end of the fixed tterm (12 months), we co-tenants asked for the current tenancy to be ended early and a new tenancy drawn up wiht just their names on it. I think we are all jointly liable until the current contract runs out.

    I was given a letter stating that the co-tenants would pay back the deposit minus deductions for the repairs - I thought it was the landlord only who could remove money for repairs. We are having an independent inventory person come round to do a check who will write a report stating how much we are required to cough up. I think the idea is that the co-tenants are sayign this amount will be taken out of my deposit which I don't mind since I have to pay it anyway but I just don't want them taking any extras. They refused to give me back £100 but then slapped a bill for £30 for a party we had. The pettiness of the two of them defies belief.

    For example, I spent a whole day driving over 100 miles to pick up this furniture which now does admittedly require some renovation work. They refused to give me money for them on account of them being a little worn but when I said that I would take the furniture instead, they refused that too, stating that they still want to keep them and I quote "the fact that you picked them up doesn't change anything at all". It all smacks of double standards and since it's got this ridiculous, I'm worried they'll take some more money off for outstanding bills.
    If they do, what can I do about it?
  • Do you know, for your own sanity I'd recommend that they deduct whatever the heck they like and you walk away. Sometimes money, unless it's a vast amount, just isn't worth the fight. These flatmates sounds completely loathsome and I think you'd be best just getting out any way you can and then you can get on with your life without these horrible, poisonous people in it.
  • Just thought I'd let you know that I've moved to a new place which on the face of it seems soooo much better.

    Thank you for all the advice. I went for the simplest option, leave everything! That way my conscience is clear and they can stew in their own rotten juices.
    All in all I think I will have lost about £500 to those ***ts but watch this space for news about deposit.
