Hi:

I have taken the above company to Court after them having left the site, half way project, and being paid most of their estimate in cash.

Desperate to get some money back I have only claimed for a relatively small amount.

County Court just sent me a letter stating they owe me and should pay the claimed £2200.

I just checked their company on companieshouse website and

It now shows as “dissolved”.

My question is: would I be able to get any of my money back?

has outstanding court judgments, banned from websites and is SO bad and so dangerous he is served with a Immediate Prohibition Notice by he HSE.

if he comes and tries to do work, call the authorities. A real danger

Northumberland Trading Standards are in my honest opinion the worst organisation I have ever come across, they actually claim that it's not in the public interest to prosecute Rogue Builders who commit serious fraud in relation to elderly and vulnerable people, despite there being numerous cases (in to double figures and most with Building Inspectors Reports or CCJ's) and allegedly as many as 24 complaints.

According to FOI requests Northumberland Trading Standards had one prosecution in five years for £100 at the Magistrates, and may as well not exist.

They will try and hide behind the morally bankrupt LGO, and the limited powers of other organisations, but their own incompetence and ineptitude is plain to see, as is that of their management.

They even accuse the very people who are the victims of crime of wrong doing and collect pointless data which they will keep about you for at least six years including medical data and personal sensitive data and hide behind the fact they can collect data under their remit, so be extremely careful what you tell them as it will inevitable end up on their records, indeed a lot of the records they kept on us were not even correct and was also very trivial and was used to discredit us, and we were the victims of fraud.

Northumberland Trading Standards constantly harp on about their limited powers despite taking cases directed to the police by a concerned MP back in to their fold, in order to take no action. Indeed the police even offered to help but their request was turned down.

Our only regret is letting Northumberland Trading Standards on to our property in the first place.

I saw this post online and I am very upset that you took to the internet to report this. i have had work done by Mr fittes and I found him and his work to be first class. As any building works you do sometimes get some problems it is inherent that this DOES happen. I had a couple of minor problems which were fixed straight away. I know his wife had a brain injury in 2014 and he was unable to work so I think bad timing and I understand he offered to re-do the work for FREE.
Your post is slander and you should do more due diligence and if someone does not come up to your high expectations give them a chance to put it right before taking your cowardly internet forum posts the the great and good !!!!!!!!

I saw this post online and I am very upset that you took to the internet to report this. i have had work done by Mr fittes and I found him and his work to be first class. As any building works you do sometimes get some problems it is inherent that this DOES happen. I had a couple of minor problems which were fixed straight away. I know his wife had a brain injury in 2014 and he was unable to work so I think bad timing and I understand he offered to re-do the work for FREE.

Mark Fittes - BSG/ WeatherAll / Bowmont Conservatories/ Bowmont Home Improvements

Just to put the record straight, Mark Fittes never offered to repair any work for free and we went on to win a Court Case in relation to his companies workmanship, indeed the Judge called Mr Fittes deceitful and economical with the truth in his summing up. Sadly the CCJ remains unpaid like many of Mark Fittes other debts.

There are numerous debts left by Mark Fittes companies such as BSG Limited and WeatherAll Limited and I know of numerous victims of this man, and we even visited our local MP along with other families, regarding this mans activities, and the police were even in attendance at that meeting.

Furthermore Mr Fittes has an ex-wife, and a girlfriend and was not married in 2014.

As for your work I can not comment, however I have never seen Mr Fittes carry out any work, he just employs cheap subcontractors and uses equally cheap materials, indeed in our case he didn't even supply or use the materials that were supposedly ordered.

Mr Fittes has a well documented history of bankrutcy, companies being struck off and liquidation, and some of his company records are there for everyone to see on Companies House Beta website whilst the London Gazette website provides details of his bankruptcies.

I know Mr Fittes is allegedly operating another company called Bowmont whilst Bowmont Home Improvements use the same Logo and are based at a Garden Centre in Northumberland and operate in the North East of England, the company has been offering conservatory roofs, windows and other home improvements.

Given our experience and that of numerous other people I know of, I would steer well clear of both Mr Fittes and his companies and can only warn other people about this man, who even charged us VAT when not registered and used illegal contracts.

The disgusting mess that Mr Fittes company left when they walked off the job without finishing was appaling, even the Judge called it appalling in Court.

As for slander, I think you will find that what I have written is called 'fair comment' or indeed 'honest comment' and is merely based on the facts.

So someone else has been taken in by Mark Fittes, as Gaz Hendo has not been made aware of the facts.” Due diligence” on checking the facts first should have been applied here. Some of the details that follow have already been posted but they have obviously not been seen or ignored.

This is not a one off; the number of complaints that were made to Trading Standards about Mark Fittes were in the mid twenties and went back to at least 2012. It is not cowardly to go on to an internet forum, but it is cowardly to run your business and take advantage of elderly and vulnerable people.

In some cases the work was not up to standard and in at least 2 cases deposits were paid by customers but no work was carried out yet the deposits were not repaid. In the case I posted it was found after a complaint to the authorities about his company WeatherAll, that Mark Fittes had spent the couple’s £8.5k deposit within 11 days, so was in no position to fulfil their contract as he was already in serious debt. Mark Fittes did, however, tell people that he had paid the deposit back and that he had been left out of pocket, saying that he had bought supplies. It was only when he was confronted about these claims he made a repayment offer to the couple of £200 a month which would have taken around 4 years which they could not afford, nor did they trust him as in every conversation they had had with him they found out later he had lied to them. They also needed the work doing as soon as possible because the woman has degenerative spinal problems, which Mark Fittes knew about. The couple would also have had to sign a confidentiality agreement which would have prevented them from being witnesses when Trading Standards took Mark Fittes to court.

That is why they went to county court to prove that he owed the money personally, because he made them pay the deposit into his personal bank account, not the limited company’s account. Nowhere on his business cards or flyers did it say that WeatherAll was a limited company. The couple obtained a County Court Judgement (CCJ) against Fittes personally in December 2015 for just under £11k as the judge agreed that Mark Fittes was personally liable. Mark Fittes lives in his fiance’s house and when you send the bailiffs in he says he has no assets so this debt remains unpaid and consequently the woman has lost all her medical retirement lump sum. Mark Fittes went personally bankrupt in May 2016. The couple have a document from the official receiver which proves that the debt has not been repaid. He left their debt off his application for bankruptcy and they believe it was so he could show people the documentation and say that he had paid the couple back. He came out of his bankruptcy in May 2017 but managed to go abroad on holiday 3 times during this time.

On the same day Fittes informed the couple that his company had gone into administration (it never did - he just stopped trading) and they would not get their deposit back, he set up a website bowmont.net for a phoenix company Bowmont Roofing and Building Services which offered the exact same services as WeatherAll NE Ltd. Bowmont.net website now redirects to Bowmont Conservatory Roofs which is based in Wansbeck Garden Centre , Ashington.

Trading Standards took Mark Fittes to magistrates court but when he elected to be tried in the Crown Court and they would have to pay for a barrister to represent them , the CEO of Northumberland County Council dropped all charges for 3 separate cases stating in April 2016 ".... the need to consider value for money and the pressures of managing finances within Local Government. Pursuing this case was not a sensible option in my opinion."

Mark Fittes has been telling people that there is a “vendetta” against him because he has had bad luck in his business. There is no vendetta. It is because Mark Fittes has upset the lives of so many people that live in his area that he is very well known for his business practises and even some hard headed business people are disgusted by his actions. It is upsetting when lies are consistently being told and your intervention proves this.

Anyone, as you know, can have difficulties in business but it is suggested that you look at Mark Fittes` business history which is available for anyone to see and make your own judgement. If Gaz Hendo actually knew the true circumstances of some of Fittes` customers even he might be shocked.

All of this information is known to Trading Standards, Northumberland Council, the local MP and the police
