how would you get a reproduced key if theres no original to copy from and as all the documents are with the car and im assuming the key code card is with the documentation that went with the car, what would they code a copy from to disable imobiliser and open doors? no key code they cant produce a central locking fob, noy key they cant reproduce a key!
Registration number will probably be enough info to produce a key.
But they'll probably want some proof of ownership.
  • op:
how could you report stolen when not insured on that vehicle? tell police yes they will retrieve it but then its logged on the database as stolen, then recovered, you will have to pay recovery cost for the vehicle if recovered by the police wich is usually covered by insurence when you report it to them?

if you were the policy holder on the car and he was named driver how did he cancel the policy? named drivers cant cancel policy's as their not policy holders! and i also thought that if your the registered keeper you have to be policy holder not a named driver??

So are you saying an uninsured vehicle can't be stolen?
Recovery will be £150, the OP said the car is worth 9K, I'm sure she'd pay that.

The garage will only want the vin number. This can be obtained from the reg.

If you bothered to read the OP's posts, the ex was the policy holder and the OP a named driver.

ok my bad you can get a key made from the vin number. but as i said how did op's ex insure the vehicle as policy holder if not registered keeper in the first place in my understanding you had to be registered keeper to be policy holder!

i only say this as i bought a car when i was 18 reg'd in my name but insurance was way too high did have an anitial quote but when they had the numberplate it rose over 400 a year over the initial quote of 900 total of 1300, so my dad offered to go policy holder and me named driver as it was only 550 a year then but was refused as my dad wasnt the reg'd owner keeper of the car and i had to settle with policy holder with dad as named driver and came back to 900 a year dont know how that worked but hey.

chippy read again! i didnt say it cant be stolen because of no insurance, i said it would be costly, and collection may be higher than 150, police rcovery fee's plus the police will only recover not deliver to door it will be taken for storage where op will have to arrange collection, and pay any storage fee's usually covered by insurance.

""tell police yes they will retrieve it but then its logged on the database as stolen, then recovered"",

yes i could of worded better i admit but the first few words were ment as insurance wise as the cars not covered in op's name,

plus recovering stolen rcovered will deminish the value of the car anyway, as being reported on police national database as being stolen recovered.

You don't have to be RK to insure as policy holder, AFAIK you don't have to name the RK as a named driver either. But you won't be able to tax it without the RK being named driver on the insurance, the PO won't allow it.

That's because it was just a policy of that particular insurance company, if you go to a site like "go compare" you will see options for declaring that you are not the RK. Then it brings up insurers who are willing to cover in those circumstances.

    Update -
I went to police who said as i had given him permission to use the car in the first place i could not report it stolen, its a civil matter.
I paid to get a replacement V5 and was told if he tried to use the original one to register it in his name they would write to me to confirm i wanted to transfer it (they also said the old V5 would be invalid as a new one had been issued). I called his new insurance company to say he was not the registered keeper and they were going to get their investigation team onto it.
Went to a solicitor who have sent a letter giving him 14 days to return vehicle, the 14 days were up on 30/12/09 so looks like it will be a court matter now. Doe anyone know how long that is likely to take?
I called the DVLA again today to make sure i was still registered keeper only to be told it is now in someone elses name!!!! They would not tell me who that person was though.
Its all so frustrating and i am so angry at the moment as there seems to be nothing much i can do to get this car back! Where do i go from here or is it just a case of leaving it to the courts? Does he actually have any chance of winning at court?

    Grateful for any advice/replies :-)

Your solicitor should be able to advise on that

If you are no longer the keeper of the vehicle, probably good that it is in someone elses name. You don't want all those speeding tickets landing on your mat do you?

Again, something your solicitor would probably be in the best position to advise on.

I am seeing solicitor this week but was just wondering if anyone had dealt with something similar and how long it took to sort it out.
So having the V5 in his name doesn't mean he has anymore right to keep hold of it? I thought it might do..?

How does that work??? You have the V5, but someone else is now the registered keeper without DVLA contacting you about the change of ownership?
