    Well, I finally got a copy of the contract.
    16 weeks was the deal, didnt seem to bad at the time, but now its going to be a nightmare. I guess just need to sit tight and hope something happens.

    i guess you need to kick up a fuss !! - never mind sitting tight ! go see the manager and ask him what feedback there has been and how he can progress this sale, ask where he advertises it etc etc - you are the paying customer - go for it !

    OP, arrange to speak to the manager of the branch you are dealing with. Catalogue any errors they have made before you have the appointment. Tell them you atr not happy with the service you are receiving & you want them to put an action plan into place, which all parties agree with.


    Tell them, if they fail to keep to the action plan, you have will have the right to give x days notice to terminate the contract. Get them to agree to this & put in writing.

    I am a Sales Manager for a firm of Estate Agents & the last thing I want is an unhappy vendor, lets face it, they are going to tell more people about the bad service thay have received than any good service they have received.

    Don't just wait for the 16 weeks to expire, your property may have become stale by that point & another agent may struggle to sell it as a result.

    Its the branch manager I have been dealing with from the beginning, and the person I have been complaining too. Nothing seems to be happening.
    I am getting fed up with continually having to ring them.

    Could you possibly give me an example of the type of action plan you would suggest as an estate agent manager.

    I know they cant force people to come and view the property, but I cant believe no one wants to have a viewing.

    To be honest the whole thing is confusing, an estate agent only makes money by selling a property, and the fact we want to buy the other house with them, you would have thought it would have been even more crucial. Almost seems like the opposite is happening. We had the offer accepted on the house, and now nothing.

    write to head office then !!! THEY certainly wont want to lose 2 transactions if you go elsewhere

    I will check on Monday, but I am pretty sure the place / people I am dealing with are the head office.

    I suggest you might get your solicitor to have a look at the contract for you. They may have an idea as to how to proceed.
    Our solicitor looked at our contract with our EA before we signed it because there were some bits saying that we would be charged a fee even if another agent sold it or it sold within 2 years even if they were not marketing it any more. They said something about the buyer may have been initially interested by thier sign even if they viewed it with another agent. We were not happy with this clause and they happily let us refuse to agree to it. Wasn't going to pay 2 fees!!
    If it is sole agency then you have to do every thing to get out of it.
    How about threatening to pull out of the sale of the other property unless they let you have multiagency agreement-at least it gives them a chance to sell your property if they can get their act together and another agent to have a go if not.

    We dont have a solicitor yet as I wouldnt consider we were at a stage of needing one. The contract gives them sole selling rights for 16 weeks, after that period if the property is sold by another party they dont have any entitlement to commision.

    Just looking back over this thread - this post suggests you had not seen the contract terms and were unaware that this tied you in to 16 weeks.

    You are not bound by any terms you have not agreed to - did you sign and send this contract back? If you didn't and there was nothing in writing to say the contract was 16 weeks, you can terminate when you like.
