Hi

Mate of mine came off his scooter due to diesel spilt on roundabout.

The roundabout is right beside a haukage firms depot and my mate has been and looked and a lot of the lorries have signs of diesel spillage and really poor caps on the tanks [inc a carrier bag in one instance!!!]

Could he sue the haulage firm for the repairs to his scooter???

  • This is first and foremost a matter for the police, or VOSA.

Assuming you don't know the vehicle which spilt the diesel, then contact the MIB.

One of their schemes is for compensating drivers when the offending driver cannot be traced.

This is first and foremost a matter for the police, or VOSA.

Neither of which will take a damn bit of interest.

Arnold Clark passed my car through it's MOT with brakes that didn't work and simply made up things like tyre pressure readings ... VOSA said it was a trading standards thing!

Your mate could report his accident to the police and state that spilt oil causes it but he should have done that at the time it happened for evidence's sake. But, unless someone saw the oil coming out of a tanker the police won't be bothered.

Just wait, though, as once a few children die on the roundabout then an MP will get involved and push for something to be done. Thank goodness we've got kids to die so that the government actually takes action about things eventually!

  • He could have driven more slowly, knowing the Diesel was spilt on the roundabout... ;)

I wonder how willingly the haulage company will admit the spill was from one of their lorries??

    Waste of time in IMO.

What about if an independent witness [passing pedestrian] saw the firm's lorry spilling the diesel, a minute before my mate crashed??

I'd say that was suspiciously convenient, especially if the 'independant witness' turns out to be another mate of yours..... ;)

    Yes.

Let us know where & when the court case is. Could do with a good laff listening to the plaintiff's evidence :D
