What about if an independent witness [passing pedestrian] saw the firm's lorry spilling the diesel, a minute before my mate crashed??

I would call it a great coincidence and a suspicious one at that.

what the bloody hell are you on about?

It was sarcasm about how no intervention ever takes place until people die. Like councils who know there is an accident black spot with deaths likely to occur but refuse to spend the money to make it safe until a few people have died. Or like persistent drunk drivers who get to keep their license until they run over a child. Nothing is taken seriously until there is a death.

So I was making the point that the oil spillage problem would not be a priority to anyone until someone actually dies. Then they have to spend time and money investigation and rectifying the problem.

I realise that sarcasm isn't always clear when you're writing it rather than saying it with the appropriate facial cues - but I would have thought that the depth of the comment would have conveyed such?
I've been making animations for my daughter. Tell me what you think? Search for "Where are you Pickles?" and "Pickles and the Bully" on YouTube.

Not sure I understand your answer, other than accusing the [potential] witness of perjury.

Leaving aside your cynical sidewswipe, what about from a legal pov?

diesel is an occupational hazard for bikers, we take extra care on roundabouts and if we still fall off well its just one of those things.
Target Savings by end 2009: 20,000
current savings: 20,500 (target hit yippee!)
Debts: 8000 (student loan so doesnt count)

new target savings by Feb 2010: 30,000
  • What qualifications does you "mate" have to state it's diesel?

Just wait, though, as once a few children die on the roundabout then an MP will get involved and push for something to be done. Thank goodness we've got kids to die so that the government actually takes action about things eventually!

People simply don't understand sarcasm unless you swamp it with emoticons

I've endured the wrath of MSE for making a joke without emoticons too (reply #6 in THIS THREAD)

I knew what you meant :):):)

Then the witness would have a registration no. and time of spillage and your friend would not have had to go round the haulage yard looking for leaky trucks
    ML.
He who has four and spends five, needs neither purse nor pocket
  • He could have driven more slowly, knowing the Diesel was spilt on the roundabout... ;)

The OP says nothing about knowledge prior to the accident, or is that why you've put a smiley??? You'd come off at 10mph anyway given enough lean.

Diesel is terrible in the wet - like ice. Often the first you know you're going down is the smell.

If there are filler caps missing, then traffic police will definitely be interested. Give them a call.

You don't need to accept this.

If you google you will find no win no fee solicitors who take on (and win) compensation for cases like this.
  • Its proving what vehicle the diesel comes out of that would be the problem. even if a witness saw diesel coming from a lorry, could it be guaranteed that was the lorry your m8 slopped on?
Did the witness also see your M8 fall? At the exact spot the accused vehicle spilled diesel?
How long passed between the witness seeing it and the actual accident?
Is it only that haulage firm that uses that roundabout? No busses, other lorries, other vehicles?

I'm a biker, I know this is annoying but I'd probably go throught the MIB and then gather evidence against the firm to get them done.
