Hi,
Wonder if i can get some advice over this.....
Couple of weeks ago i was supervising my friend in her car (learner driver). We were parked in a petrol station when another car reversed into the front of her car. We swapped details and there was no visible damage on the cars....however one of the passengers of her car did submit a whiplash claim and now the driver of the other car is saying she reversed into the back of his car, and this is no way true. There is no witnesses etc and the footage from the petrol station is no longer available.
What is likely to happen in this instance and also what may happen w/r to the injury claim? The learner driver has signed a statement saying no injuries were sustained.
Any advice much welcomed.

Whiplash injury from a minor bump that causes no apparent damge to either car is extremely unlikely. Sounds like a scam to me."You were only supposed to blow the bl**dy doors off!!"0

I'm confused.
I'm sure any court would be too. "Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -
By the sounds of it, there are 3 people in your vehicle (You, the car driver and one other passenger who is claiming), so how is it there are no witnesses? Regardless, both you, your friend and the person claiming surely must agree that your vehicle was parked when the incident occurred. If you got out of the car, and left her behind the wheel, then you've left her unattended, and that could cause real problems.Fight Crime : Shoot Back.

Yes 3 passengers, the driver gt out to put the petrol in so was not left unattended behind the wheel. The driver has however submitted a statement saying there was no injuries but the passenger has apparently got whiplash.
There was no witnesses, how does these sort of claims usually turn out when the 3rd party is disputing liability.0 -
So your friend was filling the car with petrol at the time?
Why did your friend sign a statement to say no one was injured when her own passenger was?
Was it an unmanned filling station? If not I'm sure the attendant would have seen the accident, or if not the aftermath, especially if your friend was dispensing fuel at the time. I would have thought the attendant would have cut of the fuel supply due to the accident.
(Even non attended filling stations are monitored by camera for safety reasons, so again someone would probably have killed the pump had the accident been severe)
That person would probably remember whether the collision involved the front or the rear of the other vehicle.
I would have your friend have a word with the passenger. As already suggested, it's unlikely whiplash injuries would have resulted from a crash that you say didn't cause any damage to either vehicle.
Has your friend reported this matter to the police? An accident involving personal injury should have been, if the police were not called at the time. As you were the supervising driver, failure to have reported the accident may have repercussions on you too (not sure about that bit though)"Now to trolling as a concept. .... She was not aware apparently until after the statement was made apparently. So your friend was filling the car with petrol at the time?

How long after the accident did she become aware she was injured?
How long after the accident was it that the driver had obtained the necessary paperwork/claim forms from the insurer, filled it in and sent it off?
(bearing in mind at that point there was no known damage or loss to either party)"Now to trolling as a concept. .... The injured party filed the claim around 2 weeks after the incident, however the driver did not report the accident to her insurance as there was no damage and only gave details after the legal team dealing with the claim approached both drivers insurance companies.0 -
