Hi,
I upgraded today in store on my V-fone contract to the Samsung 360 - it not very good  !
Can i take it back to v-fone tomorrow to the same store and leave the contract etc and not pay any charges ?!
IE the 7 day grace period / cooling off period ?!

As confused!
Cheers
X

No, a cooling-off period only applies to distance sales i.e. over the phone or online. If you bought in store you are stuck with the contract you agreed to.
Remember that the retailer cannot resell that phone as new, it's now secondhand and it's value has plumetted.

    Are you positive?
    - The 360 doesn't do anything that the guy in the shop promised it wood! so i feel like i have been mis-sold!

If you can demonstrate that you were mis-sold, then yes, that is another matter. But proving it will only be your word against his.
Might have been a good idea to check out the phone specs yourself before you signed though.

    Well many things don't work:
    - Bought for facebook - but there is no app like the v-fone promised, there is this 360 thing which only shows status updates, you can't comment on these status's, you can't view peoples facebook photos like v-fone said you could!
-youtube app - comes out at 1/100th of the quililty that you would expect, you can't even make out what your watching!
    - the menu skips back to the start when you try to flick across it!
    - texting buttons (keyboard) rarely detects the correct letter!

Just generally is useless and doesn't work like you would expect!

  • i have been going over the TandC for v-fone:
    http://online.vodafone.co.uk/dispatch/Portal/appmanager/vodafone/wrp?_nfpb=true&_pageLabel=template12&pageID=AV_0080
and i can take it back if there is a fault which i believe there is! - doens't say if they refund or exchange!
-> also i can get a refund if there is no network coverage i think:::: "For handsets bought from a store we offer a 7 day no network coverage disconnection and refund. Any accessories purchased at point of sale can also be returned."

Can some please give me some advice as i don't want this phone as it doesn't do what they stated in the shop it can do and i wasn't told that i didn't have a cooling off period thingy!

  • how does the no network coverage retuens policy apply?
you say you upgraded so you must have network coverage or you wouldnt have upgraded

You cant just cancel if you change your mind.
  • Im just stating the only thing that is says in the TandC's!
    Virgin seems so good!
-> i just feel that the phone isn't even 1/4 of what they said it would be able to do in the shop!

-> Also the contract sheets, there are 2 seperate, one copy for them one for me!
I DID NOT SIGN MY ONE - does this mean the contract is invalid or void?

Nope, that copy is just for your reference, the oen they have is the one that needs to be signed.
