Need help with CSA issues

Hello all,

I am divorced and a father of 2 girls, one is 9 and the other one is 6.

I really need some advices from all of you with my CSA problems !

Here is my story :


How can the CSA order me to pay arrears when the case is re-opened?

The CSA never told me they were going to increase my payments or by how much. An investigation was opened, 6 months later they tell me I have to pay (X) amount, increased from what I originally paid and on what date!!!
Ok, so far, I don't have a problem with this, the amount has changed and I've been given a new date to pay!!! Now they are telling me that I have arrears from when they reinvestigated my case and I have to pay for every month they spent doing this???? This came completely out of the blue, no-one mentioned this, no-one requested I budget for this and no-one told me I'd be handed a huge debt out of no-where!!! I've got no money as it is, now if I don't pay they are taking me to court?!?!!? It's complete blackmail and they have me over a barrell!! For example I apply for a loan and it takes them 6 months to give me an answer, and they say ok : I have to pay £319 a month, and they are going to back dated for the last 6 months from when the application went in. So I now own them an arreas £1914 so they will just add it onto my repayment. So now I own them £715 a month till the arrears is paid off.

Thats what the CSA is doing to me.

They must be breaking the law in some ways either through the FSA, or some other law, also I have not signed any official document to say they can do that or how much I have to pay ???

    I'm going to move your post to the board for CSA issues :) I think you will probably get more answers there and you will on the DFW :)

    I think that you're also not the only one in the last few weeks that has come up against this exact scenario so have a look on the board and see what advice has been given to the other people in your situation :)

  • Am out of date now with CSA issues but historically you could 'apply for credit' in certain scenarios i.e. if your children stayed with you overnight for so many days a week. Effectively, that reduced the amount of maintenance due. No idea if that's applicable in your case but thought it might be worth mentioning.

    If you can't afford to pay what they assess going forward, have you tried asking them for longer to pay i.e. spread the arrears over a longer period?

    Sorry, if none of those is now applicable.

    I'm assuming by investigation that a new case was opened?

    There is a calculator on the CSA website which would have gave you an indication of what you would have had to been paying and hindsight is a wonderful thing but really this money should have been put away each month until the assessment was done.

    However, it's done now. How much are the arrears for? They do like arrears to be paid within 2 years so you could call and try and advise you will pay X amount over your normal maintenance in a 24 month period to get the arrears cleared and then go back to paying your normal amount.

    Ahhh....have just read how much your arrears are,

    So you could ask to pay £79.75 per month towards your arrears on top of your assessment that you have been given.

    If you have the children to stay overnight then don't forget that your assessment will be reduced by 1/7 for each night they stay. SO if for example your assessement was £70pw and they stayed 2 nights a week, then you would pay £50.

    tell em u cant afford to pay that amount and go to citizens advice they will help u i promise...

    Let me tell you guys a bit more about my case.

    I started to pay to CSA from 2006, but because I get paid by dividents, so I dont have to pay anything for the CSA (according to their laws). But I still give cash to my ex which was £120, and now is £200 per month. And my ex is on child benefit, and coucil house at the moment.

    My ex wife applied the application requesting the CSA have a look again about my case in April. So till 30/04/2009 I have received the letter from CSA informed me they've received an application for a variation to a child maintenance from my ex and

    I have heard nothing from them untill the 22/09/09 stated that I have to pay £6 per week from 18/03/09. But on the 07/10/09 I have received another letter from them said that I have to pay £73.71 pw from 18/03/09. Only after less than one month, how come they could change their decision that bloody quick?!?!?! That's why I have contacted them, and explain the situation that I have been giving my ex £200 per month, (and she admitted that to the CSA as well). So they said they will have a look again about my case.

    And on the 09/11/09, they sent me another letter, stated that I didn't pay £73.71, my payment is overdue, and also said that I own them £2800.

    I called them again, after that conversation, they agreed that as I have been paying my ex £200 per month, so they deducted it, and said my arrears is about £1500.

    I dont mind to pay through the CSA, but I just disagree with the arrears, its totally out of the blue, and unfair.

    How come it can be possible?
  • OP: Why do you think the FSA would be involved in a CSA arrangment?
    When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.

    Hi border_dude,

    As I just thought they must be a financial law saying without an agreement they can't back dated all the payments without us knowing the amount we have to pay first, If they give us an amount to pay and we dont pay it, then they can back dated it. But if we agree to pay it on the date they sent the letter and we pay it, how can they back dated when I dont know how much to pay?
