They will look for proof. Sorry, but don't celebrate just yet.

A phone call between you and them Has not changed anything.

And thats from someone who is pro NRP..

ah, true, im def not celebrating until i get written proof. I have had a look at my accounting from 2005 and done an old CSA calculation (Excel spreadsheet from the net) and since my net earnings have differed the most it comes to is £2030, give or take a few quid. I still think i will be paying no mre than £5 per week and an easier debt to pay off. I will ask for a full breakdown of the final assessment and get advice before agreeing to any payment.

Also, Just a few things if anyone knows?

    1) They are going to send a request for proof of earnings, I got the impression they just want my accounting for my business, will they require anything else? Can i just send them accounting? Will i need to go back 4 years of bank statements etc?

    2) They have asked me for interim payments while they calculate my real CSA arears, can they do this, do i HAVE to comply or actually wait until they have a real figure i have to pay back?

    3) I specifically asked for EVERY correspondance to be mailed to me for proof, and asked for payments to be made via girocheque including the interim payments but if i recieve nothing in the post shall i just send back a letter requesting this?

    4) I wish to record ANY phone conversations with them as proof, so as long as i tell them this before the phone conversation, am i within the law?

    Cheers!

If you have accounts that have been verified by an accountant that will be sufficient - there are a couple of threads on the go about SE accounts at the moment so it would be worth having a read.

    2) They have asked me for interim payments while they calculate my real CSA arears, can they do this, do i HAVE to comply or actually wait until they have a real figure i have to pay back?

They can impose an interim assessment on you whilst SE of up to £40 a week whilst they sort it out. If the figure they are asking is less than that (or you can negotiate it to be less) then I would comply as it shows willing and you are not accruing any further arrears.

    3) I specifically asked for EVERY correspondance to be mailed to me for proof, and asked for payments to be made via girocheque including the interim payments but if i recieve nothing in the post shall i just send back a letter requesting this?

Put everything (and I mean everything in writing) I send mine by fax and recorded delivery so I have two proofs of delivery.

    4) I wish to record ANY phone conversations with them as proof, so as long as i tell them this before the phone conversation, am i within the law?

    Cheers!

You cannot record their conversations without informing them first and I think (could be wrong) getting their permission. All phone calls to the CSA are now recorded anyway and you can get transcripts by asking for a data protection subject access report (costs you £10 and they have to comply within 40 working days) so being honest I wouldnt bother - stick to writing!

    Good luck

    Just an update:

I have now received all the paperwork i asked for which is a good start and they have accepted interim payments of £5 per week (£20 PM) until they have re-calculated my arrears.

I have sent off all the info they wanted (photocopied it all too!)

I have also applied for Working Tax credits which i think seems to have gone through so this will also prove low earnings to them.

Now i just hope they do decent calculations!
