    Agree, you cannot go back to jail for the same offence, but the csa can apply for numerous smaller LO's - jail can apply to each LO.

    Exactly - and the whole point of it is so that they DON'T go to jail, but pay up!
  • Also, arrangement with the courts is very rarely if never, pay up arrears in 2 years, which the CSA try and force.

    It depends whether they stick to an agreement with the court - some don't and those do not then get extra options, it is then pay the lot by x date or be sent down.

    Pushing as far as court is only an option if you really will stick to whatever arrangements the courts make - the slope is too slippery for many to willingly risk.

    I had a child in 1999 and the mother and i split in 2001. I also left my job on health grounds in 2002 and so was on the dole until 2005 when i went self employed but only with low earnings (£60 and under a week) so i get housing and council tax benefit. I have had the CSA try to get hold of me for years but never confirmed who i was as i was woried that once they get me in the system i will be screwed (just like a number of farthers i know!). the last letter i saw from them was partly open and i was horrified at what they thought i owed, and it was over £30K!!!

    I wish i could just say i dont earn much, i dont own a house or decent car, or have many possesions to my name...and definetly no savings, all just so it can be settled and get a realistic figure and payment. I would prefer my ex to accept a direct payment by she wants the CSA to deal with it.

    anyone with some help?

    I don't think you are getting much sympathy here. Reading through your original post again, I can't say I have any to offer either. Your post has some big loopholes and I don't entirely believe what you say. You must have been on a pretty high income and to suddenly go on sick pay-then dole- then self employed earning only £60 or less a week does NOT add up.

    If the above were true, you'd surely be only TOO HAPPY to divulge this to the CSA to reduce your payments, rather than ducking and diving from them.

    Are you now surprised that your ex wants to use the CSA, especially where you have wilfully neglected your child all these years? Hmmmmmm. I think she is due a very nice holiday with your child, luckily she'll soon be able to afford one.

    Pretty much how my ex did it - went from earning $100K Canadian per year down to $9K, then to $3K all as self employed, and then to nothing and became a student again. Cdn government still ordered child support based on the $100K earnings, as this was what he was obviously capable of earning with no real explanation as to why he wasn't able to any more. They put it as if he had children living with him and had to support them, he wouldn't be able to reduce his working hours, nor would he be able to quit work altogether and go to school full time. Unfortunately, some parents see this as their way out of providing for their children - usually in spite to the PWC.

    what about the people that have always payed for there children via DEO but are still having liability orders enforced due to CSA hash ups
    I only speak of my own experiences. and research that i have carried out whilst dealing with my own case with the child support agency

    according to some on here, they don't exist. all arrears are genuine. :rolleyes:

    some compliant NRP's are already in prison its a sad sad world we live in

    I have read a lot on here (sorry i didnt reply sooner) and thanks for the ones who have given advice but to the ones who say i deserve it well, you dont know me or what i have had to go through prior my relationship with the mother and after. first, i had to move 100 miles away from a huge mess which was depressing to say the least but wont go into here... after leaving the mother i went into deep depression anyway and was off work on the sick, my work was suffering and they wanted to let me go anyway but couldnt as i was on the sick, to top that i lost my home and seeing my child so i moved in with a friend 14 miles away, into a tiny bedroom...so, with CSA trying to track me was the last thing on my mind, i was in a very bad place mentally.

    I finally found my feet after going self employed as there wasnt any work but as a PC repair guy in a tiny rural village i dont get much custom thus the low income. I would like to move but im not unhappy at the moment.

    I have tried and tried to sort something out financially direct with the mother but she is having none of it and wants the CSA involved. I too am facing up to the CSA and trying now to sort of any mess but not if they just want a ridiculous amount. I AM on low income so im sure if even it went to court they can only get me to pay what i can afford?

    Im not one of these rich dads avoiding any payment, i dont have massive savings or hidden cash...no assets or house.

    The contact i have made is via their website contact form, not a letter, just to see if they will at least respond, if not, then a letter it will be, if still no response i will await further contact or even contact the court to challenge the letter i received.

    40% of income i dont have is just stupid if they try to push for it and why i am angry with their practices - 3 close friends who pay the CSA have all been totally messed about by them, some nearly going to financial ruin over CSA errors.

    I do want to sort this out and await some sort of response. Im sure if they want me that badly i will get one and get the ball rolling.

    If you want to get angry, get angry at the politicians expenses, the fathers with millions who openly refuse to pay the CSA, the working benefit fraudsters, the bankers using tax payers money for big bonuses...not someone who has nothing but trying to work, pay bills and be above board as much as possible!
