    I mean I am paying the debt back to O2 via Moorcroft Debt Recovery, but as I stated I didnt know there was a DEFAULT until it was too late.

    Fingers crossed this should work.

    Any suggestions what I can do about PROVIDENT default (thats going to bite me in the bum for a very long time I'm sure of it), they are proposing a plan called FRESH START. But I really want to get the DEFAULT removed.

    Get everything about Fresh Start in writing first.

    Make sure they state:

    1. All fees / interest or the fact that there will be no fees / interest
    2. The fact that the default will be marked as satisfied with Experian and CC
    3. The fact that the account will be removed from the debt colleciton agency
    4. The fact that a new account will appear on your credit report being marked as paid up to date for every week / month that you stick to their proposed agreement

    If you can't get all four points in writing, to your satisfaction, don't bother. In the mean time, just chip away at it the best you can, you can't be expected to do any more than that!!

    Good luck with T-Mobile and O2, and expect for the first few letters to be thrown back at you. Just persist ;)

    Just out of curiousity PROVIDENT didnt send me a DEFAULT NOTICE could I use this as a form of evidence that the DEFAULT be removed.

    If not then I will do as you suggested above with the FRESH START.

    I just received this back from O2:


    Thank you for latest response. I’m sorry to hear you’re unhappy with my response.

    Unfortunately, we’re not legally obliged to send you a letter warning you of our intentions to apply a default to your personal credit file because we’re not governed by the Consumer Credit Act 1974.

    In line with the terms and conditions you agreed to, payment must be made within 14 days of the bill being produced. Due to non payment the contract was breached and we followed our credit control procedures.

    Section 13 of the airtime agreement states we’re obliged to accurately report your payment history to the credit file agencies and because the balance is still outstanding, the default will remain until it’s paid in full. It will automatically be amended to show as settled when it’s cleared.

    I appreciate how disappointing this must be for you, but I hope I’ve answered everything clearly.

    If I can help with anything else, I’m available Monday, Tuesday, Thursday and Friday between 8am and 6:30pm. Alternatively, the department is open Monday to Friday 8am to 6:30pm and one of my colleagues will be able to assist you.
