Hang on a sec, if the cheque arrived today you are not 'getting the money back in your bank' as it hasn't been cashed.
But the Ebay are giving you the money?
So you are getting £64.09 profit?
At least that is how I have understood it.
If so, I don't think I could live with my conscience, as you have lost nothing, and made a profit from a sellers small mistake.

If you sent a cheque and it hasn't been cashed then nobody has lost anything other than time. You may well want you cheque back so you know it can't be cashed.

Thinking about this, 2 things don't make sense - 1/ you want the cheque back so you can get the money back into your bank - it's not been cashed so therefore no money has gone from your account. 2/ If ebay are refunding you, you must have told them that you paid by cheque, it has been cashed and you have not received the item hence why they are refunding you - yet you know it's not been cashed - why else would they be refunding you?

Good points so if the OP told ebay the cheque had been cashed they either have a very very poor understanding of basic banking or they lied to ebay.

Also just to say with ebays new resolution system (where they phone you) I have heard a few cases of ebay refunding people who paid by non paypal methods in disputes

Anyway OP its up to you are you an honest person?

Two things just occurred to me why didn't you just fund it from your bankaccount (surely your account is verified). If not if you have an account with a cheque book i'm sure it has a debit card so why didn't you pay through paypal with this as your funding source?

I didnt pay pay through my bank account as i dont have it set up with paypal as a direct debit also i dont have credit cards and i dont have a cheque book, the cheque came from my bank. I am a honest person thankyou and i have contacted paypal about last nite so i wont be getting the refund into my paypal account just to let you all know Thanks
