  • Hi NID,

I should have explained it better!

My account was still in good shape in 2008. I only stopped paying the loan recently. The account is still with Barclays at this moment.

Barclays bank did not actually close my loan account in 2008. Maybe that’s only some sort of paper transition in their institution for some unknown reason. I believe I am not the only customer had this. I knew nothing about the change of the account number etc. at that time.

My point is the original loan account /agreement I signed with them was closed (terminated) in 2008 (according to the statement they sent me). The loan was given a new account number with a new start date. Do we still treat this loan account as the original one I have signed with them and the enforceability is the same?

What options do I have if the enforceability is the same?

    Thank you again.

Hi, Can I add attachments to a post? I'm looking at attaching a CCA which I've been told by my creditor is enforceable which I would like guidance on. Unfortunately I can't seem to be able to add it though and the posting rules say I may not post attachments, but this differs from the FAQ on adding them?

  • Aloha,

I wrote on here a week or two ago and NID gave some sage advice. Basically everything I thought I owed has dissapeared.

I had a couple of bad debts. One with Barclays, and one with HSBC. The barclays one I pretty much hid from. It's been over six years. It doesn't show on my experian profile. I thinks it's been statute barred? Good i guess.

The HSBC debt got me a CCJ. Or at least i think it did? i got the court order through demanding payment. i have been payng £200 a months directly out of my wages since 2007. It shows up on my payslip as CO payment.

    Here's the funny thing...

I just searched myself on Trustonline and it says i have nothing registered against me. Not a thing???

I'm still paying my £200 a months...cos i got a CCJ?But it doesn't appear on the trust website? What is going on and how can I figure out how much more I owe?

    Many thanks

My wife has some credit cards that are up to date etc, but the agreements that she has seem to be unenforcable if she stops paying. My question is has any one managed to use a unenforcable agreement as a tool to get the monthly interest charge on a active account reduced???

Nope, nothing you can do as a tick in box is perfectly acceptable as a signature as it was an online application.

It would appear 100% enforceable from what you've said without even looking at it. Sorry but you're not going to get much joy from this i'm afraid. ;)

Hello again NID. My Virgin card was ticked. Am i still ok ignoring them? Was this the third option ;) you never wanted to put on here.

My acc is gettin charged almost £300 interest a month.

I still worry what will happen next as its enforceable :(

    Hiya

Sometimes when you query the validity of a debt (i.e. s.78) the lender removes the entry so take nothing as granted right now. To really see what is going on, SAR them (Page 1) :D

You can only add jpg's not pdf's like you've created. When you send the email i'll take a look for you. :D

wouldn't work mate - at the end of the day the fact it is unenforceable would make them reduce the limit and eventually cancel your account as they would realise they are at risk.....

    Not worth it really ;)

Did I look at the virgin CCA - I dont remember much about it mate but if it had the tick in the box i'd not have said it was unenforceable just with that alone...... can you remember the posts? I can't...?

However, if it has the prescribed terms and the tick in the box then you'd assume it is enforceable and so it'd be time to negotiate a payment plan or similar - option 3 is also an alternative ;)
