it was MBNA credit card, taken out on the 11/10/2006, debt £3900, i asked them for the following, copy of executed agreement, up to date terms and conditions and a recent statement, they sent me all 3. but the signed agreement only has a tick box (ticked)but no signature or signed date, I sent another letter saying i was in dispute with MBNA, and i wish a copy of the signed agreement, they said this was the signed agreement as the tick box has a tick in it, This account isn't in arrears or have any missed payments. is there anything i can do?

Nope, nothing you can do as a tick in box is perfectly acceptable as a signature as it was an online application.

If it was MBNA then probably was.... what type of card and how did you apply then? If you done it by post, then the handwriting on the CCA will be yours - right? So, is it?
If it is then you're snookered. If it is not then you can do them for fraud, so you need to start being more specific cos right now what you're saying just doesn't add up, i'm afraid.2010 - year of the troll

this is the problem i have, it was done by post, the application form was accepted and CCA was send to me along with the credit card. at no time did i sign it (and return it), or tick a box, i'am not sure what to do, should i take it to a lawyer then? of the FSA?0

Ok, so you hand completed the application form yes? Did you get sent a copy of that from MBNA with your CCA request or was it suddenly typed? OR did they send you a pre-printed form that just needed your signature? Its the only 3 option available - so must be one of them.
