  • Have you been able to see if anyone else got caught out by this, i.e google it, there might be letters to the local paper about it, might be worth ringing the Croydon paper to tell them about it? May help your cause.
  • Thanks Peter! I will go and measure the bays, I really doubt they're illegal but it's worth a try I guess!

    Spammy, a few weeks ago I did a google search and found someone else who seemed to have a similar problem but I've not been able to find it again. I'm not sure how many other councils have a similar scheme so I've no idea whether there's likely to be many examples of this happening elsewhere.

    I Googled a bit and found this, so the paper already knows about it and may be interested in a follow-up article:

    Also there have been lots of objections, 971 formal objections were received before this piece of carp was typed by Croydon Council:

    I would go through the above drivel with a fine tooth-comb if this is the area in question, biscuitdunker.

    I have skim-read it and found quite a few interested parties/groups mentioned as having objected - you could do worse than contact them whilst also lodging your formal appeal without delay. If it goes to PATAS then you may be able to gather more ammo from these objectors and find other wronged motorists perhaps...

    Also correct me if I am wrong, but doesn't the published answer to Objection No. 31 clearly say that 'NONE of the parking arrangements will come into force until completion of the works'? 'The works' presumably being the improvement scheme by Ringways stated early on in the rubbish spin-document as being due for completion in DECEMBER 2009...

    P.S. I don't think you have scanned in a copy of the front and back of the PCN, and all the wording on to NTO yet? Maybe there are technical issues which could make them take a running jump if you word your formal appeal well or scare them into folding before any PATAS adjudication.

    P.P.S. Have you posted a thread about this on www.pepipoo.com or consumeractiongroup forums? I would - I am sure they can help with the wording of your formal appeal this week and may have other info to add. Don't miss your deadline to formally appeal.

    See above for more...Chipstead Valley Road is mentioned and clearly says that the new parking arrangements are 'to be implemented on completion of the improvement scheme'.
    Has it all been completed then? If not the Council were lying in their 'spin-document'...

    The thing you mentioned about the new parking arrangements only being implemented on completion of the improvement scheme is interesting, because I distinctly remember there was still work going on when I got the ticket. There was a zebra crossing which hadn't yet been opened and there was still stuff going on around the new roundabout at the top of the road. I assume this was part of the "improvement scheme" mentioned at the meeting. Unfortunately, the works look to have been completed now, but they definitely weren't completed back in August. Don't know if this will help me though.

    Will scan my stuff now..

    I think it might help a lot - but I am not an expert on these matters (just had a bit of time on my hands to Google for some info for you and I am trying to learn as much as possible about this subject myself).

    I am wondering if Croydon Council even had a TRO in place for the street in question by August. The link I gave you (repeated below) suggests to me that they might not have put a TRO in place even now, if the work is still going on, because it was never their stated intention to regulate the area until the work was complete:

    AFAIK, in order to make a formal Traffic Order, the Council need to have 'Consulted' and then 'Advertised' the changes properly first. If the document I posted the link to above is the 'consultation' and it's dated July - then how can they have started to issue fines straight away the same month? No advertisements? No sealed TRO in place?

    If there is/was no TRO then I believe they are obtaining these fines under false pretences.

    Ring the Council tomorrow and ask for an urgent appointment to view the original TRO for that street which applied at the date of your PCN. You can get a copy too as well I think. But don't miss your deadline to formally appeal whatever you do (others will advise more tomorrow I hope, do you have only 14 days from the date of service of the NTO?).

    HTH, as I have said I am not the expert at all on these things but hope the Council document I found helps others find some snippets of info to advise you more. Also when other posters see your scans (including the back of the PCN, small print & all) they will post further I expect.
