i will call my cc company i am getting really worried. it has taken ages to save that money up for taken it all. if this is a scam then i wont use ebay ini the future.I have finally acknowledged my debt.....0

Ebay isn't the problem entirely. Read the tutorials they all start with suggesting that you check the history and feedback of your seller before you bid. Also most articles suggest using paypal for large amounts, and I would add to that and say use a credit card through paypal as you have even more of a full back position should it go wrong.
You must treat ebay like you would any other place, I'm sure you wouldn't buy from a bloke in the pub with no 'history' and no one willing to vouch for him and would suggest you need to be as cautious on ebay.
All is not lost here though as at least you used a credit card with nochex rather than a debit card. So do let us know what the CC company say, and if they don't sound hopeful keep on at them as sometimes they like to try and get out of any obligation. I can't pretend that getting money back via nochex even with a card is as easy as it is via paypal, there are some strange difference between the way nochex and paypal are set up and whether they are handlers, merchants or just a middle man, but keep on at it.

update: nochex closed my ticket without even responding so i ripped into them and mbna are closed until the morning. I got the following from ebay but have written to them asking why out of the 5 auctions they closed 4 and left the last one and what the violation was the listing for all 5 was the same in everyway. I will keep everyone updated.

of course i was aware of various ebay scams but it did and still does look real. It looks that nochex offers ZERO support for this kind of thing but mbna does
basically i have to give them 30 days to deliver after that mbna will sort it for me. I have finally acknowledged my debt.....0 -
phil999 I'm not quire sure how a zero feedback can give you any indication of how good a seller is? AS for nochex the reason a lot of sellers prefer it to paypal is becuase they are not subject to as many forms of chargeback and before paying by any means it is a good idea to look to see how to get your money back if it does go wrong.
Luckily though from your post it does sound like your CC company are willing to assist, so that is good.

also as an fyi i was told i could claim it back from ebay using the link if my credit card company doesnt and the items are not delivered.

Note the £15 processing fee.
More importantly, note 'eligible transactions'
