But there is something here I don't like.
If the car hire co. has paid the fine... why on earth are the Spanish authorities sending him a letter with the fine...?
The usual scenario here would be that they send the fine to the car hire company, the car hire company identifies who was driving the car and sends the details to the authorities whilst at the same time charge the driver an admin fee. Then the authorities send the fine directly to the driver abroad and the driver bins it. Fair enough.
Agreed. And all up for binning the fine as my recent post mentions!
If they're saying they've paid it, then maybe a random Spanish way of resolving it? I'm guessing the T&C's of the hire must mention they'll do this, otherwise they have no right to do this. If the fine is legitimately re-charged including a small admin fee, then I guess fair is fair?0 -

Again this is pretty standard on most rental invoices if there is any fines, parking charges etc etc the company will add an element of their own charge on top, hence why the OP's amount is slightly higher than expected.
I cant stress enough, Main problem i find is Italy they are well well known for debiting acounts as they see fit.
to VWMAN, you need to go thru a similar process for a chargeback to be applicable.
Contact the merchant they HAVE to provide you documentation to validate the charge, dates, times etc showing that car was in your possesion and your liable for charges, contact merchant if they still not giving you proof. Contact your bank, advise them you are looking to dispute a payment on your account( Mastercard hopefully reason code 4859 rs7. (Addendum Dispute). basically you agree that you have used the merchants services but you do not agree to this additional amount being billed, you have no docuementation to support the charge, you have contacted the company to get the information and they are not providing you any.
Your bank can then chargeback the transaction, the merchant HAVE to provide the docs to support it otherwise money is yours within 45 days if they do not return the relevant documentation.

Just got off the phone to RBS. The lady who I spoke to read out the rules stating that if the transaction being disputed is a charge made by a hire car company and covers damage to the car, payment of a speeding fine or something else (didn't catch this), then they cannot help. Apparently I have to take up the dispute with the hire car company.
So basically they've got carte blanche to debit my CC as often as they like and can put it down to one of the above, knowing there's sod all I can do about it (short of cancelling my card!)
This is Visa, so I don't know if the same applies as per gnaril's info above re Mastercard??
For info, I've asked Econorent to provide me with a receipt for payment of the fine as proof it has in fact been done... And have heard nothing from them for 3 days..0 -
it is atandard proceedure,what they have basically done is to pay the fine for you(although with your money)the Spanish authoroties would have sent you the document so you would know why,
the receipt is the transaction marked on your cc statement
if you get a speeding fine you pay it,its not carte blanche to debit your card willy nillyI

Hey mate sorry you aint got too far with the bank. Information above is for mastercard as they are so much easier to dispute additional charges than visa.
Im sorry but your bank dont seem to be very helpful regarding the charge, there is another ways to get around this.
For visa they can request a copy of transaction details. This can be dispute as transaction not recognised Reason code 75. This way they can charge it back and the merchant has to then provide documentation to validate the charge.
Another avenue would be a possible precompliance ( basically getting them on a tecnicallity). The merchant SHOULD provide you with an invoice/quote for damage and repairs prior to billing you, they cant tecnically just debit your account, there is process/procedures in place and they are meant to act via the correct channels( 90 times out of 100) they dont.
I know you could get them on a pre compliance with mastercard on this at the end of the day, visa im fairly new to sooooo not 100% but i would assume its going to be similar. I would get back onto your bank tell them you want the more help. you have recieved no docuementation to validate the extra charge and unable to contact/resolve with merchant, you want it chargedback in effort to assist in getting the car hire company so called proof/validating the extra amounts.
The stuff from RBS is bull !!!!. YES if the charge is definately for fines/ fuel etc then sure they aint going to get involved, BUT if the charge has not been identifed + Documented ( you have only been told verbally which aint worth the paper its printed on)and explained as to what is it then there is options available to get you the information needed. They need to provide you a record of times/date etc.

but he has been told by the car company that it was for a fine and he has the fine from the Spanish authoroties
the statement is acceptable to the spanish authoroties that you have paid and therefore is seen as a receiptI

If any of these people with their car hire issues have recieved documentation to validate the charge excelling, nothing much more card issuer is going to do. at that points is a customer/ merchant dispute.
However if these people have not received any documentation to validate these charges(proof). then above information can be acted upon and chargebacks actioned to get the proof of these additional charges which the merchant must provide.0 -
Like I said before the fact is verbal means nothing they have to show documentation to support the charge.
It cant be:
Car rental company - Oh you were caught speeding 1st october you were charged £100 due to this, we have billed this to your credit card.
Customer - oh really can I get the information to show this as I dont believe I did/ or car was returned 2 weeks before the speeding fine.
Car rental company - sorry cant provide this......
Obviously this is a very very basic but hopefully people get it.0 -
My statement reads:
27/10 Econorent £118.67
How the hell can the Spanish authorities derive from that, that it is for payment of a speeding fine?
I already mentioned before, I'm not trying to dodge payment, I just want proof that the fine has in fact been paid. This doesn't prove anything other than the fact they have debited my card.
