The phone network 3 are calling T-Mobile customers quickly brushing over the fact where they are calling from saying "3-Mobile" then saying to the caller that there upgrade is due most times it actually isnt. Then continuing the conversation offering obscene amount of minutes & a new phone. If customer agree's and the package is sent out and the customer opens it the package to check the phone - its seems like your now tied to the contract with the 3 network.
Does anyone know if there is anyway to return and cancel this contract once you have opened the box?
Thanks

its not actually three that are calling, its a company who are totally separate. they called me when I was still a three customer last year, about 2 weeks after I had upgraded early, which is how I knew they were nothing to do with three.
best advice is to be aware of these scams and avoid !Bow Ties ARE cool "Just because you are offended, doesnt mean you are right" Ricky Gervais0 -
I think you have 7 days cooling off period.
BUT what I'd like to know is how would 3 get enough details to set up an account for you. Surely they need to do credit checks and so forth?Squirrel! If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.
Now 20% cooler0 -
As with most credit agreements isn't there a 14 day cooling off period?0

Under Distance Selling Regulations, you have 5/7 days to return the item at the postage expenses of the customer.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
If you didnt walk into a shop and upgrade then yes there is a cooling off period...its breaking ofcom rules if there is not one0

The 7 day period to return is going to be tough to enforce if its a dubious 3rd party selling them.
Question - how come its just t-mobile customers details that get passsed on to 3 or whoever? Its not going to be 3 as others said of course.0 -
OneADay raises a good point, if T-mobile is leaking details to a 3rd party without consent, they are in breach of Data Protection.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

I agree, I used to be a store manager for T-mobile about 2 years ago and received one of these calls. Never did manage to get to the bottom of how my mobile number (and contact details) managed to be passed to a 3rd party but I had definitely not given permission.
The person ringing even called me a liar when I explained that I worked for TM and got my phone for free (up to a certain amount). Great sales technique!!Any opinions are my own and are offered as advice only and not fact.0 -
i'm on o2 and get these calls quite often... I always play along and ask for phones I know that 3 don't offer, like a blackberry 8900 (doesn't have 3g) or a phone running the android operating system..
Ok, yes, i'm a geek, but I know i'm in my contract, and these people have no idea when it actually ends, so it just doesn't happen to people on t-mob

I believe either Vodafone or dail-a-phone do the same thing, thinking about it as i had an offer made of phone insurance but it didn't tally up with the price i had agreed to with Dail-a-cover. It turned out on a brand new contract only a few days old i was been offered insurance by a 3rd party company, not the one i had signed up with. So it does happen!Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
