  • I'd be careful in my experience the Credit card provider has unlimited time to get hold of the agreement not 12+2
    my credit card provider were given 5 months and at least 4 requests... So if they don't repsond it doesn't appear that you can do anything about it. Good Luck anyway

    No, you used a company that ripped you off. Forget what they told you, it was utter bollox - we've already established that from your last thread. The fact of the matter is that after 12+2 days you can then cease repayment as they have defaulted in the process.

    Whether you do or don't is personal choice, relevant dependant upon whether they have already defaulted you or not. :D

    Are you shocked they didnt roll over and send you a nice letter saying that you don't owe them a penny.

    People wonder why we are in a recession !!! Because people like you won't/can't repay what youu have borrowed. Unless people learn this can't go on things everyone else will have to suffer. I have one default on my file and I never attempted to avoid repaying my o/d I just wanted to pay it back at an affordable rate.

    They are not closing anything! lol - you do speak some rubbish!

    It is part of an act, the act that was passed in parliament and trust me unenforceability is here to stay! You're getting confused with one case that was rightfully overturned. Your friend in finance needs a slow hard slap :T

    I sent of letter 2. CCA REQUEST as you suggested never-in-doubt, and cap1 have also started texting me asking that i call them(i call them all sorts constantly, what could they mean:rotfl:.

    Why they just couldnt send a copy of the original agreement or admit they aint got one makes me.:mad:

    Well they are now calling me from the philipines.

    I have had 4 calls so far today, they call and say they are eriel calling for cap1 can i speak to so n so. I ask them for there name knowing they wont give it, in the end they just hang up.

    I am so glad i managed to log into the cap1 online facility to change my contact phone number to a mobile, i just put the phone on vibrate;).

    It comes from a list of 'dodgy numbers' and its fun to annoy them with dodgy calls of our own lol

    I dont think i will use the dodgy numbers never-in-doubt, they might set the cops on me:eek:.

    Cap1 sent a statement today they have added charges of nearly £100 for interest and late payment sum.:mad:

    Surely they are breaking some kind of consumer credit licensee laws.

    Update:
    Today i received a letter from cap1 stating ''that although not required under Section 78, i am enclosing a true copy of the original executed agreement''.

    Also the covering letter said this is there final responce relating to this matter.

    What it was is an application form with both signatures but no prescribed terms, the terms and conditions were on 3 seperate 4a sheets.

    Does this mean i can now be 100% confident that no enforceable agreement exists as they have stated in the letter that the application form is the agreement.:j:j:j:j:j
