Capital One CCA Request

Hi, i'm sorting out my debt as i can no longer meet the minimum payments.

I have had a classic credit card from cap 1 since 2001 and i have never
had a default or missed payment. The last year i have not used the card
as i'm trying to clear it.

Outstanding Balance about: £3000
Next Minimum Payment about: £100

I want to CCA Request the card company to make sure they have a legal
right to charge me the interest as they are wanting to increase it by nearly 10%.

Any help would be appreciated, i especially need the address to send the
CCA Request too. Thank's in advance

    Send to their complaints dept, address on back of statement!

    You do know that if they increase the interest rate, you have a right to demand it stays at old rate until balance is paid off afterwhich the account becomes closed. They cannot enforce you pay a higher rate, unless of course you use the account.

    Stop using the account, tell them to p!ss off and CCA them for unenforceability! lol

    Yes i had to look into it, as the letter they send suggests that you must clear the balance if you dont want to pay the new rate(which is not the case as in your reply above).

    You must clear the balance, but not all at once! You can still maintain the original terms but then not use the card!

    Sent of the CCA Request via first class recorded delivery to:

    Executive Office
    Capital One Bank(Europe) PLC
    PO BOX 5281
    Nottingham
    NG2 3HX

    I used letter 1 which is linked to in post 2 above(i changed the reference of cheque to postal order and dated it), i await there responce.

    Don't start that nonsense again! Its not wriggling out of anything as i've told you on numerous occasions now. If you do not know the law then please shut up - do us a favour! :mad:

    I was just about managing to pay the minimum, and then i get cap 1's letter saying they are going to increase the rate by nearly 10% because they were getting charged more by whoever they lend off.

    If they can change the rules like this i want to know it's legal and above board. I'm not 'trying to wriggle out of paying anything' as you put it, i'm just trying to play by the rules.
