Actually it's an open forum JLHE - like it or not then so long as people are not abusive they are perfectly allowed to post anything they like on this or any other thread... Chill out. I am not really critising you, I am critising the system, the do gooders who are making the UK a laughing stock around the world. A system that pays(income support,housing benefit) a known terrorist and supporter of hatred against the Western world, more than a frontline soldier. A system that will allow you to borrow money for whatever reason and not pay it back, and be covered by law and sympahised with on these forums, helped out on these forums, and then be allowed to attack those who say it is ethically wrong. You give me one good reason, it doesn't even have to be good, just one half decent reason why you should not have to pay this back. I reckon hand on heart that you cannot say that you have had a laugh about this with friends, about how clever you are at beating the system.(well how clever NID is, as you have only copied and pasted all their hard work, and are still managing by all accounts to mess that up)Debt free. Andy - it is not ethically wrong - it is legally right and that is unfortunately the key difference here.
Your opinion (moral beliefs), or anyone else's for that matter, doesn't matter a hoot in a court of law - that is what you need to understand.
And its not a case of me being clever, its about my understanding of the law and being able to keep my beliefs away from the facts at hand, i.e. the law. Believe it or not I don't owe a penny and always pay my debts on time. Kinda like a lawyer defending a murderer, doesn't mean he's murdered in order to defend one!

I understand what you are saying NID regarding the law. I just worry that the banks seem to getting more support now regarding claims etc from the courts, and in JLHE case, this has been going on for some months now, and I hope for his sake that he doesn't find himself with even more debt problems, if it doesn't go his way, as he hasn't made a payment for so long.Debt free. I thought the object of any forum was to offer advice and/or an opinion - not to stir up emotions. I did mention to andy in my first reply to him to start a thread if he wanted to discuss the morality of the law.
No need to trash this thread, it just makes it annoying for others and they may then miss a relevant point.
And if he posts anything abusive then I am sure you'll press the report button
posting differing opponions however does not as far as I know constitute abuse (or at least not under the rules as they are laid out in the forum guides

we both know it's an emotive subject - we sit on opposit sides of the fence
- but everyone is still free to post what they like so long as they do not breach the board rules in doing so 
It may annoy people (I can think of countless times when I have thought contributions across the board to be worthless or even nothing more than stirring) - however if it doesn't contravene the rules then there is nothing stopping people posting it.
If it does then report it to abuse and they will deal with it as they deem approriate
But you know this and I'm actually only re-iterating it for the newer members to MSE so it's not particularly aimed at you NID

The banks aren't getting any support as such, moreso the judges dealing with the specific cases are not knowledgeable enough to supplement a decent argument to set precedents. As a result, all the recent cases that appear to have gone the way of the banks have actually underlined what we always said, the CCA was written to protect us and protect us it will continue to do.
The recent cases have done nothing, other than help the lender with that specific case - no precedents have been set - also you'll find the appeal courts are going to be extremely busy in 2010.
Regards to JLHE - he'll be fine, don't worry about him - we're here to help him and won't let anything happen. He's in very safe hands
