    However, after they default me, I don't really want to ignore them as I want that default removed. If they don't, should I be making a complaint to the OFT and possibly initiate court proceedings? Otherwise, until then, it is only a bluffing game.

    Exactly, but the default can remain until you go to court which isn't something i'd be doing right now.... the law is very unclear and you may find that you're made the scapegoat....

    Personally, look at the saving you make and walk away..... ;)

    Failing that send the letter to the CRA's (from page 1 of my thread) and demand they remove the default - you do this last of all though.

    There's now a sudden twist to the story!...

    I've now received a letter from an agency acting on behalf of the bank which, in small print, actually bears address of the bank. They are asking for the whole amount back.

    Doesn't bother me though. I'm just wondering whether to ignore it or send another letter. Or maybe I should be reporting this to the relevant authorities; after all, this is now unlawful demands for money.

    Just ignore it mate - as I said, best to walk away from this whole episode now. If they hassle you then visit the thread (link above in other post) and send the relevant letter to stop the harassment... :D

    Now they're starting to telephone - even at night! I haven't answered yet, but I know it's them from the number; besides, I haven't been around to pick it up.

    I'm just wondering, should I be sending a letter off to warn them now, that I'll be reporting them?

    You just send the following letter to them matey :D
    Dear Sirs,

    Account No: XXXXXXXX

    I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

    I have verbally requested that these stop, but I am still receiving calls and I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

    Be advised that any further telephone calls from your company may be recorded and used in evidence and I expect this harassment to cease immediately.

    Hi there, just keeping you posted on recent events.

    I've had a letter again - from the credit collections saying that I should contact them and that I owe money. They say that because I didn't sign, they are not obliged to take my phone number off their records and I guess they're trying to justify their calling me. I answered one phone call and told them in no uncertain terms that they are harassing me and that they should only contact me in writing. They, of course, deny that they're harassing me.

    Also, they are threatening possible court action. Should I respond to these threats or just ignore them, since I'm just going to be repeating myself here.

    Oh, and Happy New Year, by the way! :beer:

    Now I've had a letter from their in-house solicitors, saying that if I don't pay up or make reasonable offers within 7 days, they are likely to instruct court proceedings. What next?

    I have just read this whole forum and I find it rather disgusting. I am all in favour of reclaiming PPI and bank charges, but to try and wriggle out of debt this way is wrong. You borrowed the money, pay it back. Everyone else seems to try their hardest on DFW to repay, even when peoples circumstances have changed so much for the worse.
    I realise that you may feel this is the only solution, but it is us who will suffer. If you win this case with your credit card company, they will only pass it on to us, and we will repay more.
    May I ask what you spent your credit card money on, and why because of some silly loophole, you do not feel you should pay it back.
