Vindictive action by woman who lost insurance court case against us

Wife had an accident a few years ago, in hospital car park. Anyway, to cut a long story short, fault was contested and it ended up with other party trying to claim in small claims court (they lost).

The other party has now made a complaint to the hospital to say that my wife brought up confidential medical information in court. All she did was repeat information provided to her by the woman driving the other car at the time who was in a state and said her husband was in hospital with a heart attack.

Luckily, medical record access is audited and my wife did not at any time access any medical records for this person or her husband.
However, shes been called in to see her manager whos obviously got to investigate the complaint.

So annoyed, wonder what else this woman is going to try. Any comments?

    The cheek of the woman! Presume you wife is in a union, I would keep them informed and if she is not happy with the way the meeting is going to withdraw and get the union in on it.

    So your wife can prove the medical records were not accessed.
    Anything said in a courtroom is subject to "absolute privelidge" (iirc) and you cannot be sued for it under slander laws. So legal action cannot be taken by the woman.

    I think my approach to the management interview would be a) I did not access the file and b) what was said was said in court in evidence so this is nothing to do with the hospital.

    Of course if this is the NHS they have their own little bureaucracy so good luck to your wife.

    Looks like her manager has put two and two together here though and worked out whats going on but I guess they've still got to investigate.

    Before the court case this woman phoned us once or twice with abusive calls (until we told our insurance company and they put a stop to it).

    Shes got our address from the court case. Dont want to get up one day to find 4 slashed tyres. Maybe I should have a word in advance to the police? Or will they do nothing?

    Wouldn't hurt to get a crime number from them. Atleast then if anything did happen they would already be aware of the details.

  • Yeh. But I've got a feeling plod wouldnt bother even if our tyres did get slashed...
  • A crime number incase she slashes the tyres!? The Police wont be able to do anything until a crimes commited.

    Better to try and nothing come of it than never to try though I guess.

    I have had my car vandalised before and I found the police nothing but helpful. There wasn't much they could do as there was no way to find out who did it but they still did everything they could and also contacted me a week later to ensure there had been no more damage since I last spoke to them.
