Carphone Warehouse & Vodafone Mobile broadband...stuck in the middle

Hi,

About 5 or 6 weeks ago I signed up for mobile broadband with free laptop with vodafone through the Carphone Warehouse.Instore the sales assistant checked vodafones coverage map and my postcode came up as very good for 3g coverage.

However the signal has been appalling,for example I tried to download some vodafone software and the estimated download time was 7 hrs 53 mins!Pages are very slow to load,sometimes 5 or more minutes.I have had a 3g signal once in my home and once at mums house,the rest of the time it is GPRS.

I went onto Vodafone's e-forum and posted my problem.One of the admin on the site said that yes my postcode on the coverage map came up as very good but when he put it into Vodafone's internal checker it came back as very poor.

I contacted Vodafone who have admitted that it is their mistake and said that I had cause to cancel the contract but that I would have to go back to Carphone Warehouse and get them to ring Vodafone whilst I was instore.So off I went to Carphone Warehouse who refused to do this saying that I was outside of their returns policy which is 7 days.I am outside of this but because I was told at the start the coverage was very good I persisted hoping it would get better(silly I know!)

After speaking to Vodafone again who again said go back to carphone warehouse,I did this but still no joy!I have contacted Carphone Warehouse's complaints department who say that the only way they will cancel is if Vodafone put it in writing that they will not charge Carphone Warehouse for cancelling the contrat....Vodafone will not do this.I have also been in touch with Consumer Direct who said that I should get it in writing from Vodafone that they accept responsibility for the coverage map being wrong and to take this to Carphone Warehouse and negotiate from there.I have an email from Vodafone stating this now but have yet to take it to Carphone Warehouse.To be honest I dont hold out much hope!

I have read somewhere that these returns policies do not hold up against law.....does anyone know anything about this or can offer me any other advice????I'm at my wits end...I dont want to be paying £30 a month for something that doesnt do the job.
