quick update- have got appointment with citizens advice this afternoon, have also emailed and posted a copy of the letter ras suggested to the bailiffs and also emailed and written a letter to the head of council tax recovery dept also as suggested by ras.
i have wrote a note to hold to the window if the bailiffs do happen to return saying the following:
i am not answering the door to you nor letting you in my house, you have refused my payment and i know my rights.
leters of complaint have been sent to your offices,the council and other organisations. I AM NOT REFUSING TO PAY THE DEBT NOR DEBATING THE AMOUNT I OWE TO THE COUNCIL. dated 21st/10/09
is this the right thing to do? or will i be making things worse by showing them this?0 -

Cos she is the guru and CAB are plainly twits.
Bailiffs cannot ad a charge each time they visit. In the absence of a levy they can charge for two visits, no more, ever.
Speak tpo herbie21 if you want assurance.
And make a formal complaint to CABIf you've have not made a mistake, you've made nothing0 -

The CAB are supposed to be knowledgeable in these matters, and are in fact running the campaign to have bailiffs regulated alot more, so therefore should know more than they have said!
I would ring up the manager at the CAB office and complain about the advice you were given by their staff - mainly that the advice was completely wrong and not even legal0 -
Well, i didn't like to say but CAB aren't the best.
They lack a proper structure, you go into one in one town you could get the best advice in the world plus tonights lottery numbers, in another town they wouldn't be able to tell ye where the front door is.
Information isn't passed down as a policy from the great thinkers on high.
You're relying on the chance that your local CAB has hired someone with necessary knowledge and experience in the field that's causing you bother.
They do their best and can be worth a shout but it's luck of the draw!Would you ask the wolves to look after the sheep?

have tried council again and managed to speak to the recovery dept manager who i emailed earlier, he had a quick look at my email and explained all what had happened etc etc and he said he will call the bailiffs and ask them not to call again for the time being whilst he looks into it for me and will call me back pobably 2moro and let me know whats happens from now,so fingers crossed this might resolve the bailiff situation otherwise im gonna give herbie21's helpline a call.0

update on situation- council man just rang back and said all i owe bailiffs is the legal charges for 2 visits! apparantly they ''added the other charges incase they did levy/wpo''!! ha ha ha what complete & utter bull,!!! anyway he said bailiffs was happy to speak to me regards payment methods and he had no problem what so ever with what i have offered to pay. anyway rang them back and she said under no circumstances can she make any sort of payment arrangement without the levy/wpo. told her straight that she was not coming in my house nor was i signing anything & she abruptly ended the phone call. rang head of council tax back and he said he will try and sort something out and get back to me.
some kind of result in a way as the bailiffs fees have been resolved but still nothing sorted as in getting this debt paid.
am i to expect anymore vists from the bailiffs or do you think they realise they are not going to get anywhere and just pass it back to council if they dont take it back?
any advice on whether i should now pay the bailiffs their fees that have been corrected and are legally due to them now(via internet or telephone) or still pay nothing to them at this stage? if i pay them now won't they just stop calling??0 -
No, they will still keep calling cos the original debt is still there.
As i said in my previous messages, pay the council direct. You dont have to ask their permission to do it, the automated system just lets you. All you do is just pay it off via the councils website. Then when the amount owed to the council (the council tax bill and court costs, NOT the bailiffs figure) is paid outright send a cheque to the bailiffs for the £42.50 which is owed to them for their time.
Thats the easiest option to get this sorted without paying the bailiffs directly or letting them in your home. After alot of experience with bailiffs they wont setup a payment plan without a signed wpo to fall back on. They do that do A) bump up the amount they get andits a backup if you stop paying. Also if a wpo is signed and they setup a payment plan, if the payments are not made on time (even 1 day late is bad) then they revoke the payment plan and come round and remove your goods. Try to remember that when they have the wpo signed then they are legally allowed to enter your house without your permissiona and remove your goods - that is law.
So in summary, just pay the council direct via the website at the £200 you agreed, they email you reciepts (its an automated system) so keep the copies of these. Then when its paid off send a cheque/postal orders to the bailiffs for the £42.500
