ha ha just rung bailiffs back to qeury what they have actually levied re; levy charges and she said nothing,they can charge that amount incase they do have to levy. she also said the enforcement fee was for when they came on saturday with the van and it is fair as it is scaled off a percentage of what i owe???
they have just flatley refused any payment from me as i told her under no circumstances would i let her in to my house so she said she cannot accept any payment then as she HAS to come in and levy before they can make a payment plan??
what do i do now???? write letters to both them and the council stating all this and now make my payments directly to the council as advised on here earlier?

Yep, that was how I was scammed ten years aago before I learned my rights - ended up with a WPO fee and a van fee even though I was paying off the whole debt (had put the DD into the bank instead of the Council so had to pay the whole whack via the bailiffs).
They have absolutely no legal right to refuse a payment in this circumstances.
Please send the letter to Dukes that I posted above.
Can you check out when your local councillor has the next surgery, or find their e-mail address tonight?
Tomorrow, please ring the Council again and ask for the name of the revenue protection Officer - or the person who has the same responsibility (basically the big boss in the CT collection set-up.
You then need to write to that person and pretty much tell them what you put in the post above. State that you were in a position to pay £300 and then x per month but
1. The bailiff refiuse to accept the payment unless you agreed to a WPO/levy which means you incur another £450 fees.
2. They have already added and are insisting on payment of illegal fees.
Copy that letter to your local councillor and if possible take a copy to the next surgery.If you've have not made a mistake, you've made nothing0 -

And can I just say Jade, good on your for finding out your rights and I hope you dont let it just drop there. Go to the council, make them change their collections company, and when this is all over for you go to your local paper to out the company and insist that other people find out their rights before simply paying what a "voice of authority" is demanding!Would you ask the wolves to look after the sheep?

Just to re-iterate what others have said.
I cannot emphasise this more strongly. DO NOT under any circumstances let them into your property, they may try sneaky tactics such as asking to use the loo etc.
Do not pay them anything just now phone them back and tell them that you are happy to make an arrangement and will phone each month to make the payment(I am sure they are lying when they say you cannot pay over the phone) or to supply you with a payment book.
Provided they have not been into your property and not made a levy they can ONLY charge you £42.50 for there visits.
Do not park your car on the drive or near to your property, until a formal payment arrangement has been drawn up and you have confirmation in writing.
You can make payments direct to the council they MUST accept your payments, but you will still be liable for the £42.50 and these fees are collectable under the liability order, however they won't be able to take you to court for them as they are under £50.
They donot have to make a levy before they can accept a payment plan.
If you have the nerve and they won't accept a payment plan then just refuse to pay them and tell them so, until they enter your property they have no further course of action and will eventually send the debt back to the council, who will then deal with you and accept a payment plan.
Just keep everything locked up and don't let them in.0 -

moved the car and just filled log book in to change name over 2 my partners brother then if they do happen 2 come tomorrow or anytime after that the logbook (when its come back) will legally be in his name from today. am sure this is legal 2 do as they have not levied anything and i have no intention of letting them now i am aware of my rights and their charges!

Dont be terrified, keep calm, do not raise your voice. They will behave professionally or you'll have their jobs!
Do not collapse under their barrage of threats! You're going to sort this out and then you're going to pay them what might be legally due to them!
And you're going to feel great and empowered as you watch them drive away disappointed! Then you can take on Ryanair!Would you ask the wolves to look after the sheep?
