Exactly the same thing happened to me, but with a signed football shirt. Ebay were useless and I ended up losing my money because the seller was booted off ebay and I have no proof to make a claim through my credit card either.
On the bright side, I do have a genuine fake signed Liverpool shirt!
I will never use ebay again.0 -

Would it? I thought Ugg was generic and it was only "UGG" that was TM'ed. Can't say I care one way or another, but if the OP couldn't get her refund and wanted to sell them on ebay perhaps she could describe them as "Ugg-style", or just call them boots and post a photo with a caption

Read the original post - they are "fake". The original seller is passing them off as original products and the OP was sufficiently duped into buying them.
Other than the passing off action by Ugg, it would be illegal under the UK's Trade Mark Act together with the Copyright, Designs and Patents Act.
Ugg Australia has the word and image "Ugg" registered as a UK and Community TM in class 18 which relates to textiles and clothing. Therefore, nobody else can use the mark.
