My husband was off work for 5 months due to illness. The bank are charging us over £100 everytime he goes over his overdraft, we were shocked to find that they had charged us nearly £1,000 in total. He has nothing in the bank, his wages are taken as soon as they go in and we cant afford the bills. I am freelance so only get paid when i get work. The mortgage insurance wont pay out either due to my husband having depression. I reallty am scared, i dont know what to do for the best. Can anyone help me please?

Oh most certainly yes. Have you cancelled the mortgage insurance since clearly they will not help? Did your husband have the illness before he signed the mortgage insurance policy?
Do you have priority debt arrears(mortgage.rent, council tax, utilities)?0 -
Hi
No, we havent canceled the mortgage insurance, i didnt think we could?
We got our mortgage 3 years ago and my hubby was ill from april this year. He was off work with stress and depression and his GP said that depression is now treated within the surgery, they only refer to psychiatrists if the patient has a serious mental problem such as schtiztophrenia or not getting any better under the care of a GP.
The insurance said that unless he was 'locked up' the insurance will not pay out!
The bank he is with is the HSBC they have been bombarding us with phone calls to pay back the money that they have charged us. My hubby is back at work but he is becoming depressed again due to all of this hassel.
We dont have any other debt arrears as yet, but the bank called to say that his credit card payment hasnt gone through as there is not enough funds in his account to pay it.
we went to see the bank and ask for a consolidating loan, they could see what a mess we were in, but wouldnt help us. Every penny I earn is taken with the bills, i am trying to save to have my teeth fixed but had to use this money, so not only am i skint but in loads of pain too!!!!0 -

Cancel the repayment protection cos clearly it is not doing what it is intended to do.
Furthermore, reclaim ALL the credit card charges and reclaim the bank charges and ask the question on financial hardship

We have talked to the bank about claiming back the charges, they said that - in so many words- we havent got a chance in hell-
I feel sick, sorry, money, numbers etc ............. i am terrified of them, took me years to get a mortgage as i was scared of them!!!!
If we cancel the mortgage insurance, we will not be able to claim if hubby is made redundant will we? Flaming insurances, we had a house fire 2 years ago and the insurance company didnt pay out with that either ...... so as u can imagine, i hate the flipping companies and their small print!
What is happening, is we had to use the credit card to buy essentials to live after the fire, this as u know, is costing us a fortune in charges. We have loans and a mortgage, so when hubby gets paid all his money is taken. I am having to pay for shopping and other bills paid so we dont get into any more of a mess. The problem is, i am self employed and need clients to pay me, no clients - no money!
We are trying to fight the mortgage insurance to get the payments, we have taken it to the ombudsman (?) there are so many excuses etc as why we cant do this.
All of this is swirling around my head, i havent got a clue who to talk to etc. The banks wont talk to me as it is my hubbys account and he is on medication so he finds it hard to deal with these people.0 -

Ok,. mortgage protection guide on MSE is here:
http://www.moneysavingexpert.com/mortgages/payment-protection-insurance
That means that you can sort out that part and make sure everything is covered before you stop the old one. Furthermore, if you have charges on the credit card then there is another guide:
http://www.moneysavingexpert.com/reclaim/credit-card-charges
Take your time in reading through things and keep asking questions along the way. One step at a time.0 -
well, i have been in touch with cccs (?) they have told me to open up another bank account with a non lloyds bank and stop the direct debits from going out of the hsbc one, pay the wages into the new one then re set up the dd's.
HSBC have been charging us £150 every time we went into overdraft. Can they do this? We have worked it out that we owe them £2,000 in charges. This is terrible, how do they sleep at night?
So if i claim financial hardship can i try and get these charges back? I have read all about it and trying to get it sorted, i really feel out of my depth with all of this. I am trying to get another job, sent my cv off to 20 places, would even try and get a job serving in a shop or cleaning, its hard to get such a job with a degree, they look at you gone out when u tell them your qualifications!!!0 -

Yes you can claim them back and it's an automated computer decision so no human intervention required.

Funny you should mention cleaning cos that is one of my two jobs now and I have a degree.
If you are looking at financial hardship do you have arrears on mortgage or rent, council tax, utilities, Child maintenance, HP on a car that you use for travel?0 -
We dont have any arrears at the moment, just loads of bank charges. Having said that, erm........... we have missed a credit card payment, so yes then, there is that. Other than that, i have tried to pay the main bills, such as car, mortgage, council tax etc0

In that case reclaim the credit card charges as wellholisticmaria wrote: »We dont have any arrears at the moment, just loads of bank charges. we have opened up a new account with alliance and leicester. Hubby has requested work to pay his wages into this account. HSBC have called us to say that they want us to pay 2 months credit card bill. We said we cant pay the one so how are we supposed to pay for 2? Are they on a different planet or what?
They also demanded the £100 hubby has in his savings account, this is already taken and we told them that, then they said that there was £52 in our daughters account and they wanted that too. I wish they woul talk directly to me cos i would give them such an ear bashing. :mad:0
