    why would i write to them saying that, it might mean they won't give me any credit and i need credit as it treats my depression ;):)

    You obviously didn't read the Judgement.
    Data Protection Act
    The Court was also asked to consider whether the passing of information to credit reference agencies was a breach of the Data Protection Act 1998. In light of its conclusion that the referral of information was to credit reference was a legitimate and lawful, the Court ruled that “there is simply no basis for the contention that data is not being processed fairly and lawfully” and that the processing of data is clearly in the legitimate interest of promoting responsible lending.

    The Court therefore held that there was no basis in this case to prevent referral of information under the Data Protection Act.

    Aww bless you - you didn't read my post all, did you? Wherin I stated that I am making payments to the official receiver and will continue to do so, the official receiver sends my payments to them out to all of my creditors, all the defaulted accounts, just like a debt management plan.

    I don't for a second think that I am an outstanding cititzen.

    I made some very bad and stupid financial decisions that hurt the lenders that forwarded me credit. I am ashamed of not pulling the reigns in on my spending sooner, and I am doing all that I can to make ammends for what I did wrong. I am keeping the official receiver up to date with my state of affairs and varying the monthly contributions up and down according to income.

    I won't for one second make claims like "The banks said I could borrow £20K so it's their fault if I couldn't afford to pay it back" or "I'll let them default and do it all again in six years" or "I was depressed so I had to buy a house to make myself feel better."

    No sir. I took myself to court after months upon months of trying to find another solution and put my hands up saying "I did wrong".

    I later attended group and one-to-one therapy for anger management, depression, and dispondency.

    I am now back into work part time now that the depression and dispondency has subsided for the most part, and helping my other half take responsibility for any mishaps he might have made with his creditors, and ensuring that everything is in order for him around the house as he is the breadwinner.

    I think you need to take a reality check and do some research into the principle of being responsible.


    You on the other hand think that your depression is a get out clause. It is not. It is something that you need to take on board and get resolved and be responsible for your actions along the way.

  • well it's better to have a default and paying out about 54p r so r maybe a quid if i'm feeling flush :) and yes i do think the banks have only themselves to blame, would u lend someone down the street who without proper checks were giving out silly credit limits to people who could never afford to pay it back in the long run, i'm talking here about lending money to geriatrics who have hardly any money to live on each week getting about £70, if you had access to a credit card with a few K on it to spend i think most people would do the same thing, it's the same for younger people, the banks were giving money out left right and centre and they only have themselves to blame...

    you obviously didnt read the post you quoted
    section 29 does not remove defaults from your credit file it simply moves it out of the automatic processing which all credit searches use
    which makes it only visable to a manual search which nobody does or thats how i understand it anyway

    Thats outrageous! I had the same problem with 02, a few years back, and had to resort county court action for 02 to remove the adverse data off my credit files. You should start going the proper channels, have you received a deadlock letter from 02 or still waiting for their response? They are well known for putting defaults easily and refusing to remove them.

    Your posts are not helpful, and you are undermining people who really are genuinely suffering from depression.
