There is nothing to lose (apart from the time and money involved!). The exercise would just be a waste of both.

You are suggesting that somehow they will change the rules of the game and say "OK, although the rules are we must both stick to the ts+cs at the time of purchase to win, even though we won we'll let you use entirely different ts + cs and allow you to win"!

As I first said when you suggested it, it's just raising false hopes. And if you see the OP you'll see they are happy to keep sending out refusals, correctly based on the ts + cs that apply to this particular purchase.

Yes you are right, I apologised (see above) for missing the point that their site actually had post and pre Sept 09 t&c.

Have to agree with Quentin, think the first claim is a lost cause. The September bill was probably what they needed by 4th Oct 2009.

Better luck with the next claim.
  • OK guess ive been beaten, I get what the website is saying now Cashback Orders after the 16th means means phones contract orders not the the actual application of cashback...

Oh well at least I will be ready in december, another classic example of READ THE SMALL PRINT!!

Thanks for all your help guys all I can do now is go to the mobiles.co.uk office and keep opening the office doors so that company looses an equal amount of money in heating bills, that will make me feel better, might take a while though...

    Cheers

What was the relevant wording back in March 09 relating to which month, please? Any joy there?

    No joy at all!

Please send your bills at the months indicated as per above instructions. For the avoidance of doubt month 6 will be the bill dated in the month that is 6 months after your connection date (the date displayed on your invoice). E.g. If connected in January, the sixth month will be July so we need to receive your July bill within 30 days of the date on that bill. All other bill dates are calculated in the same way.
Important: The above bills must be sent to us and arrive within 30 days of the date on the relevant airtime bill. Claims received after this time cannot be processed. We will acknowledge receipt of your claim by email.
Please note: You must send all items by recorded post as we cannot be held responsible for lost items or claims that arrive outside of the qualifying period.

Its a complete sham operation, the use of invoice dates to work out months AND then on top of that the bill date to work out 30 or 60 days (whichever is applicable) limit to claim.

Just make sure you put down somewhere in your calendar when to send that next claim so you send it as soon as that bill arrives (remembering that you are still in the 30 day bracket).

I would still lodge a complaint to Ofcom, consumer direct, CPW just to wind up mobiles.co.uk. The change in the number of days to claim could be your basis (just say it led to confusion).

First call was in March, so by their t&c, it should have been the bill received in September.

Sorry,bath-ape, I missed the bit at the top about phones ordered after Sept 09, but just one slim hope.

Mobilejunkie - you keep t&c going back. What was the relevant wording back in March 09 relating to which month, please? Any joy there?

As I stated at the outset - if connected in March then it WAS the September bill AND only 30 days to claim. Current t&c are different and irrelevant. The "invoice date" was added very recently to get them out of trouble - even though they also recently claimed that it was "always" in their t&c - it most certainly wasn't!

Since this is more than a 12 month contract the December bill is the correct one to use for the next claim.

No longer finding excuses for them? In this instance, they haven't actually done anything wrong!

Then you will miss out on the next cashback to. It is the NOVEMBER bill you need to claim on.

    Depends on length of contract

    months 6, 8, 10 & 12 on a 12 month contract.
    months 6, 9, 12, 15 & 18 on an 18 or 24 month contract.

Those aren't the t&c in March - but they won't help since the phone was clearly connected in March and not April.
