Van removed illegally from MY private space

    Presumably he may have used his brain?
    If there are two companies involved in an area and something happens that most likely could only have happened if one or other had a hand in it, then you contact first one (the most likely), then the other.

    It's also possible that upon contacting the company that manages the flat/least/parking spot in question they said something along the lines of "I've got no record of anything happening, although X might have made a mistake about what they were doing" and pointed him in the right direction.

    It's the sort of stupid thing that I can quite beleive one company/person working for a company doing believing that they had the right/ability to do something about something they might not have liked, when in reality they didn't have a leg to stand on (it happens with depressing frequency).

    1st of all good luck to the OP and hope you will get a good outcome.

    When I read a post of someone, I take it they are telling the truth and will respond if i think I can assist. Some people probably do omit and alter the story from actual events, who knows. I see that if they are not telling all the truth to their knowledge then it does them no favours regardless of all the assistant they get from here. Reason being if in this instance the OP omit or lie regarding certain things then perhaps he is at fault and the towing people/company following the correct procedures to tow and scrapped the camper. So no amount of advice will be any good to the op as he wont have a chance in a claim.
  • lol, I thought we were trying to help people, not cross examine them like Perry Mason on speed.

    I agree with ArsenalFC above, if someone comes for advice and doesn't give the full or correct story then the advice they are given will be less likely to be of any worth, therefore it will be their own fault if they are worse off by acting on that advice.

    Anyway, as I see it, the vehicle and contents were taken from private property where it was legally parked with the land owner's permission.

    Whether or not it was taken by a company or an individual, it's still been stolen.
  • Thanks everyone! I apologise for the rambled posts, I was REALLY stressed and probably didn't make myself clear.

    1. Sister OWNS parking space and gives me permission to park in it. This is allowed. Parking space is PRIVATE. (Think of it as a driveway). Parking space is allocated away from her flat block and opposite a house who did not like the vehicle that was parked there.
    2. This complaining house is managed by Mainstay. The complainant in the house is a director of Mainstay! This is the only flat managed by this company out of about 100 flats in the block.
    3. Mainstay acting for their director write to my address giving me 2 weeks to respond.
    4. Return, find post. Ring Mainstay. Told they will sort situ and not to worry.
    5. 2 days later vehicle is taken and IMMEDIATELY scrapped. We ring Mainstay who give us scrappage firms details. We ring them straightaway and are told that it was taken and destroyed. We visit scrapyard the next day to confirm this and yes, it is a flat mess!

    Facts:
    Mainstay DO NOT have ANY rights over that space AT ALL. They should have conatcted my sister or her agency who DO have rights to that space. they did not. They arrogantly assumed they could just tow it away as my sister's space had been allocated over the rd from her flat therefore it was their jurisdiction.
    Extra info such as who complainant was was supplied during many of the angry phonecalls we made to them. My sister's housemate was enraged and it is he who started the thread off which I picked up.

    Yes, it was silly of me to leave things in the van but my sister did not have the room to store anything. I was not living in the van. I was told by my housemates before I left for Nepal that they may need to rent my room out so that is why my stuff was in the van.

    The council will not remove a T+T car on private property.
    they will if the council hire private contracting companies,they also clamp vehicles on private property.
