Van removed illegally from MY private space
Comments

First thing you need to do is find out where the van is now. I wouldn't believe it's been scrapped till I saw a grey cube with my posessions hanging out of it. Find out where these people took your van to. The actual company that took it away should be bending over backwards to help you find it. Don't spend days waiting for a scrappage certificate whilst there's still time to save the van.0

Out of interest premier why do you think someone would be making this up?
Ask yourself how, in such a short period of time, someone who had lost their vehicle (probably presumed stolen at that time) could have unearthed the fact that a company totally unconnected with the flat had arranged and 'authorised' its removal."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -
Nice footwork ... but it doesn't fool me I'm afarid.
The person who posted in post#1 you claim is your sisters flatmate. i.e. one of the people who lives at the property.
You say you could't post at that time as you were on the way to work.
That post was made at 5.24pm BST, 9.54pm India time. What are you? a nightwatchman in India?
I see this is also a brand new user account set up yesterday.
However come 6.58pm BST, 11.28pm India time you are suggesting the person who created the account in post#1 had sent you the id & password so allowing you to post yourself from India
Short working hours in India, eh?
... and you didn't think to say you were not the same person as who had created the thread, despite using the same id?
And you were still posting at 12.05am BST, 4.35am India time. Whats up? Can't you sleep or something?
Is this parking space under a rickety old bridge by any chance?
In respone, i am not in india. I arrived back in the UK on the 24th of Sept. I stayed at my sisters residence the night before it was towed as i am moving into a new house in a few weeks. Problem solved. :T0 -

So you've been back in the UK for 2 weeks ... and you have not been home to check on the pile of mail that has collected up for 3 months. :rolleyes:thiscatisalandmine wrote: »In respone, i am not in india. Lets hope there are no credit card bills or court summonses waiting for you, eh?
Also sounds like you you weren't too interested in all your worldly belongings in your vehicle, if you were happy to leave them there whilst you survived with just
2 coats
1 jumper
2 t-shirts
2 pairs of trousers
Some books and dvds
Put the shovel down."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -
Is it possible that your lease doesn't allow the parking of vans, etc - only private cars? That's certainly the case with some developments.
If it does (not allow it) that certainly gives the management company the green light to remove it - not necessarily to scrap it though.
And does it allow you to 'sub-let' the parking space anyway?
Provided the company has gone through the correct procedures there's no way it's 'theft' in the legal sense.
Thanks for a good few points
Firstly the van was non commercial, it was a private vehicle.
Secondly even if the management company actually managed the space in question - which they don't, then there is a procedure stated in the lease that requires the complainer to contact REALTY, not Mainstay and obtain an authorisation code by showing 2 utility bills and stating what the problem is. The code is then passed on to a company that deals with clamping (and not as the lease does not mention it, removal) This is just for clamping the vehicle as stated above, none of these procedures appear to have been adhered to because Mainstay never contacted Realty, they didn't check who owned the space, ask for an authorisation code and notify the resident who is responsible for the parking space!
Thirdly, according to the DVLA (need to research this a bit more) my sister has responsibility and ownership of the space and she could park whatever she wanted in the space, I am contacting solicitors to show the paperwork too as well as the DVLA to obtain another V5 registration document as the original (as well as my personal financial documents) has now been scrapped. NEVER LEAVE IMPORTANT THINGS IN YOUR VEHICLE......EVER. Lesson learnt.0 -

Don't bother with the police, they won't be interested as soon as they discover it was collected by a bona fide recovery company acting on the orders of the management company.

Correct. THEY HAVE NO CONTRACTS IN PLACE THAT ALLOW THESE ACTIONS!0 -
One wonders why you even thought of contacting this totally unconnected company in the first instance.thiscatisalandmine wrote: »Correct. THEY HAVE NO CONTRACTS IN PLACE THAT ALLOW THESE ACTIONS!
Have you not managed to think of some contrived excuse for that yet.
Must try harder. D-
